The use of any Township-owned lot which adjoins U.S. Highway 46 as a site from which to launch boats into Budd Lake is hereby prohibited.
As used in this article, the following terms shall have the meanings indicated:
BOATS
Any craft designed to travel on or in water and shall specifically include but not be limited to motorboats, sailboats and personal watercraft commonly called "jet skis."
This article shall not apply to properties owned by the Township on which are located boat docks designed for the storage and launching of boats.

Any person, firm or corporation who violates any provision of this article shall, upon conviction thereof, be punishable by one or more of the following: by imprisonment for a term not exceeding 90 days or by a fine not exceeding $1,000 or by a period of community service not exceeding 90 days.

As used in this article, the following terms shall have the meanings indicated:
PERSONAL WATERCRAFT
In accordance with N.J. S.A. 12:7-62, as amended from time to time, a power vessel defined as a Class "A" vessel by the United States Coast Guard, and which:

A. 
Is designed to be operated from a sitting, standing or kneeling position;
B. 
Is equipped with an internal combustion engine which powers a water jet pump; and
C. 
Cannot be operated in a manner so as to disengage the pump so as to prevent the vessel from making headway.
POWER VESSEL
A vessel temporarily or permanently equipped with a motor, and shall not be deemed to include a vessel propelled wholly by sails or muscular power.
WATERSKIING
Anything with a rider being towed behind a power vessel by means of a tow rope or line, except another vessel.
No person, company or corporation shall operate any power vessel or motor on Budd Lake, unless such power vessel or motor shall have been first registered with the State of New Jersey in accordance with the statutes and regulations governing registration of such vessels.
The speed of power vessels shall at all times be regulated so as to avoid danger or injury to all manner of craft, whether floating, moored, anchored or under way, or to piers, wharfs, bulkheads, draw spans or other waterfront construction, either directly or by the effect of the wash or wave raised by such power vessel or through its speed or otherwise.
A. 
No vessel shall be operated on Budd Lake on Saturdays, Sundays and legal holidays between May 15 and September 15 at a speed in excess of 35 miles per hour, from sunrise to sunset.
B. 
No vessel shall be operated on Budd Lake between the hours of sunset and sunrise at a speed in excess of 15 miles per hour.
C. 
Any applicant for a permit from the Department of Environmental Protection for a race or regatta shall submit such application to the Department with any comments or recommendations from the Township.
D. 
No vessel shall be operated at such a speed that shall cause 100% of the hull to come out of the water, except in the case of a race or regatta, where permitted by the rules of such race or regatta.
E. 
No vessel shall be operated at a speed in excess of five miles per hour within 50 feet of any shore, wharf, pier, bridge, dock structure, buoy or person in the water or designated bathing areas which are marked by a buoy.
F. 
A distance of at least 30 feet shall be maintained between all vessels operating at speeds in excess of five miles per hour.
G. 
No person shall operate a personal watercraft on Budd Lake on Saturdays, Sundays or legal holidays between May 15 and September 15.

H. 
Every vessel operating on Budd Lake shall be subject to equipment inspections by the United States Coast Guard Auxiliary or the Marine Division of the New Jersey State Police.
A. 
All power vessels towing skiers must have a crew of at least two persons.
B. 
Tow lines shall not be less than 50 nor more than 75 feet in length.
C. 
The ski boat operator shall, when a skier has fallen or has otherwise become disconnected from the tow line, reduce speed and return to the skier in a safe and reasonable manner.
D. 
The dropping of skis for the purpose of barefoot or slalom skiing is prohibited, unless the ski is immediately retrieved by the following vessel.
A. 
No person shall operate a power vessel while under the influence of intoxicating liquors, a narcotic, hallucinogenic or habit-producing drug or with a blood-alcohol concentration of 0.10% or more by weight of alcohol.
B. 
No person shall permit another who is under the influence of intoxicating liquor, a narcotic, hallucinogenic or habit-producing drug or who has a blood alcohol concentration of 0.10% or more by weight of alcohol to operate any power vessel owned by the person or in his custody or control.

Any person, firm or corporation who violates any provision of this article shall, upon conviction thereof, be punishable by one or more of the following: by imprisonment for a term not exceeding 90 days or by a fine not exceeding $1,000 or by a period of community service not exceeding 90 days.
This article shall take effect in accordance with the law, with the exception of §§ 388-8 and 388-9C and D, which shall not take effect until the Department of Environmental Protection shall adopt regulations consistent with those sections.
