As used in this chapter, the following terms shall have the meanings indicated:
ENFORCING OFFICIAL
The Director of the Township of Mount Olive Department of Health, Welfare and Sanitation or his designee.
LICENSED SEPTIC SLUDGE REMOVAL OPERATOR
Any person, firm or corporation who or which has been duly examined by the enforcing official and found qualified to pump out an individual sewage disposal system and has paid to the Township of Mount Olive an annual registration and license fee fixed as set forth in § 412-1, and has been issued a license by the Director of the Township of Mount Olive Department of Health, Welfare and Sanitation.

PERMIT
An informational form supplied to the licensed septic sludge removal operator by the Township of Mount Olive Department of Health, Welfare and Sanitation.
Any person, partnership, firm or corporation who or which, without becoming a licensed septic sludge removal operator, empties, relieves or pumps out all or a portion of an individual sewage disposal system within the Township of Mount Olive shall be in violation of this chapter and subject to § 442-5, Violations and penalties, of this chapter.
A. 
Prior to emptying, relieving or pumping out all or a portion of any individual sewage disposal system within the Township of Mount Olive, the licensed septic sludge removal operator shall obtain a septic sludge removal permit from the Township of Mount Olive Department of Health, Sanitation and Welfare which shall be in the following form (see attached form).[1]

B. 
The septic sludge removal operator shall complete all information on the septic sludge removal permit, print his name at the lower right of the permit, sign at the lower left of the permit and deliver one copy to the property owner and one copy to the Mount Olive Township Department of Health, Welfare and Sanitation within 72 hours of the time that the individual sewage disposal system is pumped.
A. 
The Director of the Township of Mount Olive Department of Health, Welfare and Sanitation, or his designee, or any other person charged with enforcement of this chapter, after giving proper identification, may inspect any matter, thing, premises, place, person, record, vehicle, incident or event as necessary for the enforcement of this chapter.
B. 
It shall be unlawful for any person to molest, wilfully oppose, verbally abuse or otherwise obstruct the Director of the Township of Mount Olive Department of Health, Welfare and Sanitation, or his designee, who may request the assistance of the Township of Mount Olive Police Department or other police agency or peace officer when necessary to execute his or her official duty in a manner prescribed by law.
Any person, partnership, firm or corporation who or which violates any provision of this chapter shall be liable for a penalty as follows:
A. 
First offense: $200.
B. 
Second offense: $500.
C. 
Third and subsequent offenses: $1,000, plus one year revocation of septic sludge removal expert license.
