By the adoption of this article, the Town of Mount Hope declares
its intent to regulate parking on the streets in the Town when such
parking may interfere with snow removal or tend to increase hazards
on the highways in the winter months by parking overnight, without
lights or otherwise, an unattended vehicle. Reference is made to the
Vehicle and Traffic Law of the State of New York § 1660(a)(18)
et seq., for the legislative authority to so enact this article.
The words and phrases and definitions of words as used in the
New York State Vehicle and Traffic Law shall be applied in the enforcement
of this article.
No person, firm or corporation shall cause to be parked on a
public highway within the Town any unattended motor vehicle between
the hours of 9:00 p.m. and 6:00 a.m. from November 15 to April 15
of each and every year.
It shall be unlawful to delay, hinder or obstruct any vehicle
or equipment engaged in the operation of snowplowing or snow removal
upon the public streets. After a precipitation of snow of two inches
or more, and thereafter until the streets are plowed and clear of
snow, it shall be unlawful for any person to park any vehicle upon
any public street while said street is being plowed or cleared, unless
such vehicle is attended by a person capable of operating it. The
owner or person in charge or in control of any vehicle standing in
any street shall move, or cause the same to be moved, so as not to
be in the path of the equipment clearing the streets of snow.
A.
Any person who commits or permits any act or acts in violation of
any of the provisions of this article shall be deemed to have committed
an offense against such article, and also shall be liable for any
such violation or the penalty therefor. Each day such violation shall
continue or be permitted to exist shall constitute a separate violation.
B.
For every violation of any provision of this article, the person
violating the same shall be subject to a fine not to exceed $250 or
imprisonment not exceeding 15 days, or both such fine and imprisonment.[1]
C.
In the event any person or entity violates any provision of this
article, the police shall warn the owner or operator of such vehicle.
If the police are unable to locate such owner(s) of such vehicle or
should the owner/operator fail or refuse to move the vehicle(s), then,
and in that event, such vehicle(s) shall be towed and all expenses
incurred by the Town shall be paid at the owner's and/or operator's
expense.
D.
Late fees:

(1)
For
any violation of a parking restriction set forth in this article,
and the Vehicle and Traffic Law of the State of New York, for which
a ticket is issued, if the ticket is not answered within 30 days of
the date the ticket was issued, a late fee shall be imposed and added
to the applicable fine. The amount of the late fee shall be equal
to the amount of the initial fine.

For
any violation of a parking restriction set forth in this article,
and the Vehicle and Traffic Law of the State of New York, for which
a ticket is issued, if the ticket is not answered within 60 days of
the date the ticket was issued, an additional late fee shall be imposed
and added to the applicable fine. The amount of the additional late
fee shall be the amount of the original fine. This additional late
fee shall be charged together with the penalty imposed after 30 days.

For
any violation of a parking restriction set forth in this article,
and the Vehicle and Traffic Law of the State of New York, for which
a ticket is issued, if the ticket is not answered within 90 days of
the date the ticket was issued, an additional late fee shall be imposed
and added to the applicable fine. The amount of the additional late
fee shall be $20 for each day after the ninety-day period. This additional
late fee shall be charged together with the late fees listed above.
