There is hereby established a zoning plan for the Town of Delaware,
which plan is set forth in the text and map which constitute this
chapter.
This chapter shall, upon its effective date, repeal in their
entirety all provisions of the Town of Delaware Zoning Law as previously
adopted and amended.
It is the legislative purpose of this chapter to provide for
the orderly and desirable development and use of land in accordance
with authority granted to Towns in §§ 261 and 266 of
the New York State Town Law. This chapter is, moreover, intended to
promote the general welfare by meeting the goals and objectives and
following the recommendations set forth in the Town of Delaware Master
Plan. These include but are not limited to:
A. Protecting and promoting agriculture as a desirable use of land.
B. Providing for commercial and industrial development to meet local
and regional needs.
C. Providing for a variety of housing types and densities to accommodate
the needs of persons of all income levels.
D. Protecting scarce or sensitive natural resources, specifically including
the Upper Delaware River and environs, and limiting problems from
poor uses of those resources.
E. Maintaining, to the maximum degree possible while accepting growth,
the rural scenic character of the Town.
F. Preventing and eliminating other hazards and nuisances.
