[Adopted as Ch. 35, Art. 1, of the 1973 Code]
It shall be unlawful for any person or persons or partnership or corporation to operate, use or maintain any store, dwelling or other building of any kind for the sale or exposure for sale of the beverages authorized by the Act of the Legislature of New Jersey entitled the "Alcoholic Beverage Law," Title 33 of the Revised Statutes of 1937, as amended and supplemented, within the Borough of Somerdale, in the County of Camden and State of New Jersey, without first obtaining a license therefor pursuant to said Act.
The Borough Clerk is hereby authorized to sign, issue and deliver all licenses for the sale of alcoholic beverages which have been heretofore or may hereafter be approved by the Mayor and Council, and he shall keep a complete record of all such licenses.

A. 
The license fee to be paid hereunder must accompany the application and shall be as set forth in the current Fee Ordinance of the Borough.

B. 
All license fees shall be paid in cash or by certified check to the order of the Borough of Somerdale and shall be turned over by the Borough Clerk, when and as received, to the Borough Treasurer.

A. 
No licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage or permit the consumption of any alcoholic beverage on the licensed premises on New Year's Day, when it is a weekday, between the hours of 5:00 a.m. and 7:00 a.m.; on New Year's Day, when it is a Sunday, between the hours of 5:00 a.m. and 12:00 noon; on other weekdays between the hours of 3:00 a.m. and 7:00 a.m.; and on other Sundays between the hours of 3:00 a.m., and 10:00 a.m. The last drink shall be served by or before 3:00 a.m., and all customers shall have left the premises by 3:15 a.m.

B. 
During the hours sales are hereinabove prohibited, the entire licensed premises shall also be closed, but this closing of the premises requirement shall not apply to bona fide hotels or to restaurants as defined in N.J.S.A. 33:1-1.
C. 
Notwithstanding anything to the contrary above, a plenary retail distribution licensee, as that term is defined by N.J.S.A. 33:1-1 et seq., but no other licensee, shall be allowed to sell any alcoholic beverages for consumption off the licensed premises (only in original containers) on other Sundays (within the context of Subsection A above) between the hours of 9:00 a.m. and 12:00 noon, in addition to any hours otherwise allowed.
No person shall sell or offer or expose for sale or barter or suffer to be sold or bartered any alcoholic beverage at any place in the Borough of Somerdale without a license first having been obtained pursuant to the Alcoholic Beverage Law.
Every license shall be exposed to public view in a conspicuous place on the licensed premises, and any omission so to do shall be presumptive evidence that such place is not licensed to sell alcoholic beverages.
The Borough Treasurer shall keep a separate account of all receipts and expenditures of fees received under this article.

A. 
Any person who violates any provision of this article shall, upon conviction thereof, be subject to any combination of the following:
(1) 
A fine of not less than $100 nor more than $1,000.
(2) 
A term of imprisonment not exceeding 90 days.
(3) 
A period of community service not exceeding 90 days.
B. 
Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such.
