[Adopted as Ch. 94, Art. III, of the 1973 Code]
No unauthorized person shall put, pile or place any refuse,
dirt, earth rubbish, lumber, stone, brick, building material, pipe
or any other substance or material of any kind or permit the same
to be and remain in and upon the public highways, streets or alleys
of the Borough thereby obstructing the same or any portion thereof.
It shall be unlawful for any unauthorized person or persons
to obstruct any sidewalk, street or public alley or thoroughfare by
or with any car, vehicle or anything standing beyond or across any
such sidewalk, street, public alley or thoroughfare so as to impede
the free passage of any person or vehicle.
No owner or occupant or any dwelling house, store or other building
shall fix, put up or erect or suffer to remain fixed, put up or erected,
except by permission of the Mayor and Council, any permanent awning
upon or over any street or sidewalk. Such permission of the Mayor
and Council shall be guided by the provisions of the Zoning Ordinance.[1]
A.
Any person who violates any provision of this article shall, upon
conviction thereof, be subject to any combination of the following:

Each day such violation is committed or permitted to continue shall
constitute a separate offense and shall be punishable as such.
A.
For any public right-of-way related to any public street, highway,
avenue, or alley maintained, operated or otherwise within the control
of the Borough of Somerdale, it shall be a positive duty and legal
responsibility to the abutting property owner to maintain said right-of-way
in a proper manner, as if said property were not subject to such public
right-of-way.
B.
Any such abutting property owner shall comply with all provisions contained within Chapter 197 of the Code of the Borough of Somerdale entitled "Property Maintenance," which chapter is hereby incorporated herein, so as to impose upon said abutting property owner the duty and legal responsibility to maintain said right-of-way in the same manner as the abutting property owner's own property.
C.
For any such public right-of-way, said abutting property owner shall
also be responsible for the removal and disposal of any dead or dying
tree that may be necessary to avoid a safety or health hazard.
D.
For any such public right-of-way, no abutting property owner, except
at his or her own risk and expense, shall construct or erect any improvement
thereon that may or could interfere with the future use of said right-of-way
property for the public good.
