Pursuant to the provisions of § 7-718 of the Village Law of the State of New York, a Planning Board of five members shall be appointed for the Village of Whitesboro, Oneida County, New York.
Pursuant to the provisions of § 7-728 of the Village Law of the State of New York, said Planning Board of the Village of Whitesboro, Oneida County, New York, hereby appointed, is hereby authorized and empowered to approve plats showing new streets or highways in the Village of Whitesboro, Oneida County, New York.
The Clerk of the Village of Whitesboro, Oneida County, New York, is hereby directed to forthwith file with the Clerk of the County of Oneida a certificate showing that the Board of Trustees of the Village of Whitesboro, Oneida County, New York, has authorized its Planning Board to approve plats showing new streets or highways within the Village of Whitesboro, Oneida County, New York, pursuant to the provisions of § 7-728 of the Village Law of the State of New York, and said Clerk is hereby requested to write to the County Clerk of Oneida County and request such Clerk, pursuant to the provisions of § 7-732 of the Village Law of the State of New York, to refuse to file or record in his office any plat of a subdivision of land showing a new street or highway until it has been approved by the Planning Board of the Village of Whitesboro, Oneida County, New York.

A. 
This article shall be known as "Local Law 1 of the year 2013 and more specifically: Alternate Members for the Planning Board and Zoning Board of Appeals in the Village of Whitesboro."
B. 
Alternate Planning Board and ZBA Members Act. This article shall apply to the appointment, terms, functions and powers of alternate members appointed to serve on the Planning Board/Zoning Board of Appeals in the Village of Whitesboro.
It is sometimes difficult to maintain a quorum on the Planning Board and/or Zoning Board of Appeals because members are ill, on extended vacation or find they have a conflict of interest situation on a specific matter before such Board. In such instances, official business cannot be conducted which may delay or impede adherence to required timelines. The use of alternate members in such instances is hereby authorized pursuant to the provisions of this article.
As used in this article, the following terms shall have the meanings indicated:
ALTERNATE MEMBER
An individual appointed by the Village Mayor to serve on the Village Planning Board or the Village Zoning Board of Appeals when a regular member is unable to participate on an application or matter before the respective Board, as provided herein.
MEMBER
An individual appointed by the Village Mayor to serve on the Village Planning Board or the Village Zoning Board of Appeals pursuant to the provisions of the local law which first established such Planning Board/Zoning Board of Appeals.
PLANNING BOARD
The Planning Board of the Village of Whitesboro as established by the Village Board of Trustees by local law pursuant to the provisions of Village Law § 7-718.
ZONING BOARD OF APPEALS
The Zoning Board of Appeals of the Village of Whitesboro as established by the Village Board of Trustees by local law pursuant to the provisions of Village Law of § 7-712.
A. 
The Village Board of Trustees of Whitesboro hereby enacts this article to provide a process for appointing alternate members of Planning Boards/Zoning Boards of Appeals. These individuals would serve when members are absent or unable to participate on an application or matter before the respective Board.
B. 
Alternate members of the Planning Board/Zoning Board of Appeals shall be appointed by the Village Mayor or other duly authorized appointing authority for a term of five years.
C. 
The Chairperson of the Planning Board/Zoning Board of Appeals may designate an alternate to substitute for a member when such member is unable to participate due to unavailability or with respect to a particular matter, for example, a conflict of interest before the Board. When so designated, the alternate member shall possess all the powers and responsibilities of such member of the Board. Such designation shall be entered into the minutes of the Planning Board/Zoning Board of Appeals meeting at which the substitution is made. The alternate member will be paid at the same per diem rate as any other member.
D. 
All provisions of state law relating to Planning Board/Zoning Board of Appeals member eligibility, vacancy in office, removal, compatibility of office and service on other boards, as well as any provisions relating to training, continuing education, compensation and attendance, shall also apply to alternate members.
This article is hereby adopted pursuant to the provisions of NY Municipal Home Rule Law § 10 and NY Statute of Local Governments Law § 10.
