The purpose of this chapter is to promote the health, safety, general welfare and to perpetuate an ordered appearance of neighborhoods in the Village of Whitesboro. The outdoor storage of unlicensed, abandoned, junked or discarded vehicles within the Village of Whitesboro is detrimental to the health and safety and general welfare of the Village. Such vehicles are an attractive nuisance to children, aesthetically unattractive, detract from the enjoyment of the environment by our residents, tend to depreciate neighborhood property values, promote urban blight and are contrary to the beautification values supported in the Comprehensive Plan. The presence of unlicensed vehicles, except as permitted herein, constitute a public nuisance which shall be abated as such in accordance with this chapter.

As used in this chapter, the following terms shall have the meanings indicated:
UNLICENSED VEHICLE
Any vehicle not bearing a valid and current registration plate required by New York State law for the applicable type of vehicle. Riding lawn mowers and tractors shall also be deemed unlicensed vehicles for purposes of this chapter.
VEHICLE
Any means of transportation intended to be operated or towed by any means other than muscular power. A vehicle is defined, but not limited to, automobiles, motorcycles, busses, trailers, trucks, motor homes, recreational vehicles, boats and snowmobiles.
It shall be unlawful to store an unlicensed vehicle within the Village of Whitesboro other than in a garage, shed, barn or similar enclosed permanent structure.
This chapter shall not apply to commercial business premises that are approved for the repair or sale of vehicles.
This chapter may be enforced by the Codes Enforcement Officer or any member of the Whitesboro Police Department.
Violation of this chapter shall be punishable by a fine of not less than $50 nor more than $250 or imprisonment for up to 15 days, or both. Each unlicensed vehicle stored in violation of this chapter shall constitute a separate violation. Each day that such violation continues shall constitute an additional violation.
This chapter shall take effect on April 1, 2007. Upon becoming effective, this chapter shall supersede Local Law No 1-2003.
