No person shall plant or maintain trees of any kind, variety or description in the twelve (12) foot unpaved area of the streets, on either side thereof, paralleling and being adjacent to the paved portion of the said streets of the Village except that the Board of Trustees of the Village shall have the power to plant or replant, replace and to maintain trees now on said twelve (12) foot right-of-way and may hire and direct the necessary persons to do said acts unless prior written approval is obtained by the Tree, Park and Recreation Commissioner.

No person shall plant or maintain bushes, hedges or shrubbery of any kind, variety or description or place, erect, construct, install or maintain any house marker, post, mail box, lamppost, light post, trellis or ornament of any variety, kind or description within the twelve (12) foot easement of the paved portion of the streets, on either side thereof, in the Village.

No person shall plant or maintain bushes, hedges or shrubbery of any kind, variety or description exceeding a height of thirty-six (36) inches in any part of the twelve (12) foot unpaved area of the streets, on either side thereof, in the Village.

No person shall construct, erect, install or maintain any house marker, post, mailbox, lamppost, light post, trellis or ornament of any variety, kind or description which exceeds three (3) feet in height and six (6) feet in width in any part of the twelve (12) foot unpaved area of the streets, on either side thereof, in the Village.

Markers, trellises, fences or hedges erected or maintained in a rectangular position at the corners of driveways or the side property lines shall not exceed three (3) feet in height and may be six (6) feet in width, along each of two (2) sides only, of the rectangle formed thereby, but said marker, trellis, fence or hedge shall not be placed, constructed, erected or maintained within twelve (12) feet of the paved portion of the streets, on either side thereof, in the Village.

No person shall plant or maintain trees, shrubbery, hedges or bushes or construct, erect or install or maintain any house marker, post, mailbox, lamppost, light post, trellis, ornament or object of any kind or description on the twelve (12) foot unpaved area of the streets, on either side thereof, paralleling and being adjacent to the paved portion of the streets of Hanley Hills unless a written permit is first obtained from the Tree, Park and Recreation Commissioner after submission to him/her the drawings, sketches and specifications for said planting, construction or erection which shall first be approved by the Board of Trustees before issuance of said permit. Said permit shall be issued without charge therefor.

In the event said drawings, sketches or specifications are not approved or disapproved within fifteen (15) days after being submitted to the Parks and Tree Commissioner, they shall be deemed approved, and said Tree, Park and Recreation Commissioner shall issue the permit therefor.

Any person planting or constructing any object in violation of this Chapter shall reconstruct or replant same so as to comply with this Chapter or shall remove same within fifteen (15) days after receiving written notice of said violation from the Chairman of the Board of Trustees, and every day said object continues to be a violation after said fifteen (15) day period shall be considered a separate offense.

Four (4) types of trees, being hard maple, sweet gum, green ash or pin oak may be planted in the area adjacent to the paved area of the streets of the Village; a minimum spacing of twenty-five (25) feet between the trees, regardless of adjacent lot sizes, must be maintained.

Nothing herein shall be construed to prohibit the erection and maintenance of sidewalks, public street lights, public utility service lines or sewers after the obtaining of a written permit from the Board of Trustees of the Village.
