A "residential swimming pool" is any constructed
pool, including pre-fabricated pools, used for swimming or bathing,
over twenty-four (24) inches in depth, or with a surface area exceeding
two hundred fifty (250) square feet, which is used, or intended to
be used, in connection with a single-family residence and available
only to the family of the householder and his/her private guests.

A. It
shall be unlawful for any person, firm, association or corporation
to construct, altar, or to commence the excavation, construction,
or alteration of a pool without first filing with the Building Commissioner
at such other place or department as directed by the Board of Trustees
an application in writing together with plans and specifications theretofore
and obtaining a building permit and paying a fee therefor.
B. The
Building Commissioner may revoke any permit for failure to comply
with this Chapter. Before a permit is revoked, the pool owner shall
have notice in writing listing and describing the instances of failure
to comply with this Chapter. The permit shall be re-issued upon proper
application and upon presentation that the deficiencies causing revocation
have been corrected.
C. All
residents owning pools in existence as of the date of passage of this
revised Chapter shall be notified in writing of the new ordinance
with a copy thereof included. These pools already in existence shall
be "grandfathered in" regarding the location or site of the present
pool. Any future alterations/modifications in size, etc., will be
considered a new pool, cause for the application of a new permit and
compliance to the revised Chapter.
1. All existing pools will be inspected immediately at the Village's
expense to determine compliance with this revised Chapter. Those residents
will be notified of the result of their inspection. A copy of that
inspection will be placed in their address file in the Village Hall.
Any deficiencies need to be corrected by thirty (30) business days
after the written listing describing the instances of failure is received.
The pool will be reinspected after that thirty (30) days. If the pool
passes, the reinspection is at the Village's expense and the pool
can remain open. If the pool fails, the owner will be charged for
that inspection, summons will be issued, and the pool will be closed.
2. All pools will be required to have an annual inspection by the Building
Commissioner by May 15, 2011 and every May fifteenth (15th) thereafter.
If the Building Commissioner has any concerns, they may call in our
Building Inspector at the owner's expense to verify if any problems
exist. Approved inspections will be kept on file in the Village Hall
under the address of the pool.

A. Pools
for which a permit is required under this Chapter shall not be located
within ten (10) feet of a side or rear lot line nor within six (6)
feet of any principal structure or frost footing.
B. No
portion of the pool shall be located in the property frontage of any
premises.
C. No
pool shall be located in the side yard area; that is the area between
the corner side property and the building corner side property line
and the building corner line, and the building setback line, unless
the side yard is fenced with a privacy fence not less than five (5)
feet in height.
D. No
portion of the pool shall be located closer than two (2) feet horizontally
to any buried power cable and no closer than ten (10) feet horizontally
to any overhead power line.
E. Pools
shall not be located closer than ten (10) feet to any portion of a
private sewage system.
F. Pools
shall be drained to the street storm sewer system in an approved manner
that will not create a nuisance to the adjoining property.

A. The
swimming pool must be protected on all sides by a barrier at least
fifty-four (54) inches in height not more than six (6) feet in height,
above finished ground level measured on the side of the barrier which
faces away from the swimming pool. Gates in barriers shall open outwardly
away from the pool, be self-closing and self-latching. Where a wall
of the house serves as part of the barrier, either all doors with
direct access to the swimming pool shall be equipped with an approved
audible alarm or all doors be self-closing and self-latching.
B. No
building, shed or bathhouse shall be erected in connection with any
swimming pool, nor on any part of the premises.
C. Outside
ladders shall have threads on steps constructed of non-slip material
at least two and one-half (2½) inches wide for their full length,
shall equipped with a handrail on both sides and are not allowed to
be in place when the pool is unattended.

A. The
water in the pool shall be clear and non-turbid within the pH range
of 7.2 to 7.6. A standard test kit to determine the pH shall be on
site at all private pools, and shall be used to check on the adequacy
of the pH treatment.
B. Every
private pool shall be equipped with a water recirculation system.
The recirculation system shall consist of pumping equipment; a hair
and lint catcher; rapid pressure filters, together with all the necessary
pipe connections to the pool inlets and outlets and for backwashing
the filters; and equipment for disinfecting pool water.
C. Cross-connections
between the public water system and the swimming pool shall not be
allowed unless they are constructed in a manner which will prevent
the back flow of swimming pool water into the public water system.
The Building Commissioner shall not approve any swimming pool plans
which do not comply with this requirement.
D. Water
shall not be allowed to remain in any unused or abandoned pool.

A. All
private pools shall have life-saving equipment consisting of at least:
1. One (1) ring buoy not more than fifteen (15) inches in diameter to
which is attached a rope three-sixteenths (3/16) inch in diameter
and of a length at least equal to the greatest dimension of the swimming
pool.
2. One (1) life pole, or shepherd's crook type of pole, at least ten
(10) feet long and having blunted ends.

This emergency equipment shall be used for emergency purposes
only.

It shall be unlawful for any person to make, continue or cause
to be made or continue at any private swimming pool or family pool
any loud, unnecessary or unusual noise or any noise which annoys,
disturbs, injures, or endangers the comfort, repose, health, peace,
or safety of others. In the operation of a swimming pool, the use
or permitting the use or operation of any radio, receiving set, musical
instrument, phonograph or other machine or device for the producing
or reproducing of sound in such a manner as to disturb the peace,
quiet, and comfort of the neighboring inhabitants at any time with
louder volume than is necessary for convenient hearing of the person
or persons who are in the swimming pool premises shall be unlawful.

The Village of Hanley Hills disclaims all liability as to pools
within the Village recognizing that individual property owners must
maintain and provide a proper and safe pool.

Any person, firm, or corporation violating this Chapter shall
be fined not more than one thousand dollars ($1,000.00) for each offense.
A separate offense shall be deemed committed for each and every day
which a violation continues or exists.
