GENERAL REFERENCES
Fire Department — See Ch. 51.
A person shall not kindle or maintain any fire or authorize
any such fire to be kindled or maintained unless:
A.
The fire is contained in an approved burner and at an approved location.
The location may be preapproved by either the Burgettstown Borough
Fire Department or the police department serving the Borough.
B.
The location of the same must be within a safe distance from any
bordering property line.
C.
All fires are limited to recreational fires and cooking fires. There
shall be no other fires permitted. In limitation of the above, there
shall not be any prohibition against cooking fires that are contained
in a grill or analogous type of barbecue facility.
D.
A responsible adult must be present at all times during said burning.
E.
All fires must be properly extinguished prior to leaving the site.
F.
A yearly permit at no cost to the applicant must be filled out for
all outdoor burning fire pits and/or fire rings that are no larger
than 32 inches by 32 inches. A listing of all households which utilize
a recreation burning fire pit will be posted on the Borough website,
in the Burgettstown Fire Department, Police Department and Borough
Building for monitoring and control purposes. However, anyone desiring
to burn in anything larger than an outdoor burning fire pit and/or
small fire ring that is larger than 32 inches by 32 inches must first
obtain a written permit from the Burgettstown Borough Fire Department
for each and every burn, together with paying a permit fee of $20
for each burn.
G.
Wood used for burning must be clean and not be painted wood or treated
lumber.
H.
All fires must be reasonable and not become a nuisance to neighboring
residents.
The provisions of this chapter shall be enforced by either the
Burgettstown Borough Fire Department or the police department serving
the Borough.
A.
Any person who violates or permits a violation of this chapter shall,
upon being found liable therefor, pay a fine of at least $100, but
not more than $600, plus court costs and reasonable attorneys'
fees incurred by the Borough in the enforcement proceedings. If the
penalty is not paid, the Borough shall initiate a civil action for
collection in accordance with the Pennsylvania Rules of Civil Procedure.
Each day a violation exists shall constitute a separate offense, and
each section of this chapter that is violated shall also constitute
a separate offense. In addition to or in lieu of enforcement under
this section, the Borough may enforce this chapter in equity in the
Court of Common Pleas of Washington County.
B.
The following shall apply for all violations of burning without a
permit. First offense, the violator shall receive a written warning
and must then report to the Borough Building and/or the Burgettstown
Borough Fire Department, whichever is applicable, within 48 hours
of the violation and register for the applicable permit. For all subsequent
offenses of burning without a permit, the violator shall receive the
applicable fine as set forth hereunder and shall be forever banned
from any and all further burning rights and/or privileges within the
Burgettstown Borough.
