A. 
There shall be no open or outdoor burning in the City of Lodi except in compliance with this section.

C. 
Open burning fires are permitted for cooking, ceremonies or recreation. No such fire shall be left unattended. The only items burned in said fires shall be charcoal or clean wood.

D. 
There shall be no container or "burn barrel" burning.
E. 
There shall be no burning of trash or garbage.
F. 
Fire Department practice burns.

(1) 
Except as provided in this section for Fire Department practice burns, an existing unwanted structure in the City of Lodi shall not be burned. A building which is no longer standing shall not be used for a practice burn.
(2) 
An existing building may only be burned by the Lodi Area Fire Department, and only the Fire Chief determines that the building is necessary for practice and instruction of firefighters or firefighting equipment.
(3) 
A demolition notification shall be submitted by the property owner to the Wisconsin Department of Natural Resources and all asbestos removed prior to the practice burn.
(4) 
Asphalt shingles and asphalt or plastic siding shall be removed prior to the practice burn unless the Fire Chief determines that they are necessary for the fire practice.
(5) 
All ash shall be disposed of in an approved landfill or at an alternative location approved by the Wisconsin Department of Natural Resources.
(6) 
At least one week before a planned practice burn, the Fire Chief or designee shall notify residents within two blocks of the site of the proposed burn.
G. 
Lodi Area Fire Chief may prohibit burning. The Lodi Area Fire Chief is permitted to prohibit any and all open-burning outdoor fires when atmospheric conditions or local circumstances make such fires hazardous.

H. 
Liability. Persons utilizing and maintaining open-burning outdoor fires shall be liable for any damage caused by the fire, including but not limited to any and all costs associated with suppression of the fire.

I. 
Fires for prairie or wildlife habitat management are permitted with the issuance of a permit by the Lodi Area Fire Chief.

J. 
The use of propane, acetylene, natural gas, gasoline or kerosene in a device intended for heating, construction, or maintenance activities is permitted.

K. 
Burning on streets. No material may be burned upon any street, curb, gutter, or sidewalk within the limits of the City of Lodi.

Outdoor solid fuel heating devices are prohibited in the City of Lodi.

The use of barbecue grills, cooking stoves, and other open-flame cooking or heating devices is prohibited closer than 15 feet from any building combustible construction with three or more dwelling units.

The use of outdoor fire pits, fire bowls, heaters or devices designed for the holding or burning of wood or other solid fuels, natural gas, L-P or any combustible solids, flammable gases or liquids are prohibited on combustible balconies or within 15 feet of any combustible construction.

Any person who shall violate any provisions of this chapter shall be subject to a penalty as provided in Chapter 1, § 1-3, of this Code.

Unless the context otherwise requires, the following definitions shall be used in the interpretation of this chapter:
CLEAN WOOD
Natural wood which has not been painted, varnished, or coated with a similar material, has not been treated with preservatives, and does not contain resins or glues as in plywood or other composite wood products.
OPEN BURNING
Kindling or maintaining a fire where the products of combustion are emitted directly into the ambient air without passing through a chimney.
OUTDOOR SOLID FUEL HEATING DEVICE
A device to generate heat, hot water or both for the interior of a building by solid fuel combustion where the enclosure in which the combustion takes place is located outside of the building for which the heat, hot water, or both are to be generated. This definition includes but is not limited outdoor woodburning heating units.
REFUSE
Any waste material except clean wood.
