Pursuant to Neb. R.R.S. § 16-251, there is hereby established a Papillion Public Library, and the Mayor and City shall have the authority to maintain the library; to provide the necessary grounds or buildings therefor; to purchase the papers, books, maps, manuscripts, and works of art, and objects of natural or scientific curiosity and instruction therefor; and to receive donations and bequests of money or property for the same in trust or otherwise. The City shall have the authority to pass necessary bylaws and regulations for the protection and government of the library, with the exception of the Board's selection of the intellectual collection, displays or presentations. The ownership of the real and personal property of such library shall be in the City of Papillion. The City shall govern and manage all library personnel in accordance with the City of Papillion Personnel Manual, and shall manage all financial matters relating to the library.

A. 
A Library Board of Advisors shall be appointed by the Mayor by and with the approval of a majority of the City Council. The Board shall consist of five members, each of whom shall serve for a term of four years.
B. 
The Board members shall be residents of the City of Papillion or the City's extraterritorial jurisdiction and shall serve without compensation; provided, however, no more than two members shall be nonresidents of the City. Upon notification of a Board member vacancy by the Library Director to the City Administrator, the Mayor and City Council shall appoint a Library Board member to fill out the term that has been vacated, no later than 60 calendar days after receipt of a suitable applicant.

A. 
The Library Director shall be under the administrative supervision and direction of the City Administrator or his or her designee, and with the consultation of the Library Board regarding the Library Director's performance. When a vacancy for the Library Director occurs, the Library Board shall nominate to the City Council a candidate to fill the vacancy, within 120 calendar days of said vacancy. Such candidate must be approved by a majority of the members of City Council. If City Council does not approve such candidate, the Library Board shall have 45 calendar days in which to nominate a new candidate to fill the vacancy. In the event that the Library Board does not nominate a new candidate within the forty-five-calendar-day period who is approved by a majority of the members of City Council, the Mayor and City Council shall have the authority to fill the vacancy. The Library Director may be removed at any time by the City Administrator with the approval of a majority of the members of the City Council.
B. 
The Library Director shall manage the Library Department in accordance with the City's financial management processes and policies.
C. 
The Library Director shall attend all of the Board's meetings, but he or she shall not vote or be counted for quorum purposes.
D. 
The Library Director shall advise and make recommendations to the Board on Library matters.
E. 
The Library Director shall act as liaison between the Board and the City.

A. 
At the Board's first meeting in December of each year, the Board shall select a Chairperson, Vice Chairperson, and Secretary. It shall be the duty of the Secretary or his or her designee to keep full and correct minutes and records of all meetings, and to file the same with the City Clerk of the City where they shall be available for public inspection at any reasonable time. No member of the Board shall serve in the capacity of both the Chairperson and the Secretary.
B. 
A majority of the Board members shall constitute a quorum for the transaction of business. The Board shall meet at such times as the City may designate, and shall comply with the Open Meetings Act.[1] Special meetings may be held upon the call of the Chairperson, or any three members of the Board, or the Library Director or his or her designee.

C. 
The Board shall have control over the Library's intellectual collection, including the selection of books and materials. The Board shall have advisory input and oversight of the library budget, and shall determine the amount in which to charge for penalties and fees for the use or abuse of library equipment, books and facilities. The Board shall establish rules and regulations for the operation and use of the library, including internet use policies to limit illegal internet use and children's exposure to obscene or explicit content online which is harmful to minors. The City shall have the authority to override any rules, regulations, and policies established by the Board, with the exception of the Board's selection of the intellectual collection, displays or presentations. The City shall have the authority to place reasonable place and manner restrictions on internet use to protect children.
D. 
The Board may recommend to the Mayor and City such matters as it deems necessary and proper for the betterment of the library, including, but not limited to, the use, maintenance, and general rehabilitation of the library buildings, grounds, and parking areas. The Board shall respond to the City's requests concerning library matters.
