The following definitions apply herein:
AIRCRAFT
Any device now known, or hereafter invented, used or designed for navigation of or flight in the air.
UNMANNED AIRCRAFT
An aircraft that is operated without the possibility of human intervention from within or on the aircraft and includes aircraft commonly known as "drones".
UNMANNED AIRCRAFT SYSTEM
An unmanned aircraft and associated elements, including communication links and components that control the unmanned aircraft that are required for the pilot in command to operate safely and efficiently in the national airspace system.
Except as otherwise provided in this section, no person, entity, or agency shall use an unmanned aircraft and/or an unmanned aircraft system to do any of the following:
A. 
Conduct surveillance of:
(1) 
A person or a dwelling occupied by a person and that dwelling's curtilage without the person's consent.
(2) 
Private real property without the consent of the owner, easement holder, or lessee of the property.
(3) 
Municipal buildings and real property owned or leased by the Village of Laurel Hollow.
B. 
Photograph an individual, without the individual's consent, for the purpose of publishing or otherwise publicly disseminating the photograph.
C. 
Fly within the border of any private real property without the express written consent of the owner, easement holder or lessee of the property.
D. 
Fly within the border of any real property owned or leased by the Village of Laurel Hollow without the express written consent of the Village of Laurel Hollow.
Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $1,500 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
