[Adopted 4-21-2015 by Ord. No. 2015-03 (§§ 5.13 and 5.15 of the Village Code)]
For the purposes of this article, the following terms, phrases, words, and their derivations shall have the meaning given:
LITTER
Garbage, bulk waste, and rubbish as defined herein and all other waste material which, if thrown or deposited as herein prohibited, tends to create a danger to public health, safety, and welfare.
RUBBISH
All putrescible and nonputrescible items, both combustible and noncombustible, including but not limited to circulars, leaflets, pamphlets, wrappers, handbills, newspapers, and all and any other printed or nonprinted paper material, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, and other similar materials.
No person shall throw, deposit, or cause to be placed litter or rubbish upon any street, sidewalk, alley, or other public places within the Village of Allouez except in public receptacles provided by the Village of Allouez.
Persons placing litter in public receptacles or in authorized private receptacles shall do so in such a manner and in such containers as will prevent it from being carried or deposited by the elements upon any street, sidewalk, alley, or other public places or upon private property.
No person shall sweep into or deposit in any gutter, street, alley, or other public places within the Village or Allouez the accumulation of litter or rubbish from any building or lot or from any public or private sidewalk or driveway. Persons owning or occupying property shall keep the sidewalks, entrance walks, parking lots, and parking areas in front of or upon the premises free of litter and rubbish.
No person shall throw or deposit litter or rubbish in any fountain, pond, wading pool, river, bay, or other body of water in a public place or elsewhere within the Village of Allouez.
No person shall throw or deposit litter or rubbish on any occupied private property within the Village of Allouez, whether owned by such person or not, except the owner or person in control of private property may maintain authorized private receptacles for collection in such a manner that litter will be prevented from being carried or deposited by the elements upon any street, sidewalk, alley, or other public places or private property.
The owner or person in control of any private property shall at all times maintain the premises free of litter and rubbish; provided, however, that this section shall not prohibit the storage of litter in authorized private receptacles for collection.
No person shall throw or deposit litter or animal defecation on any open or vacant private property within the Village of Allouez, whether owned by such person or not.[1]

Any person, firm or corporation violating any provision of this article, upon conviction, shall forfeit not less than $50 nor more than $500 and pay the costs of prosecution. Each act of violation shall constitute a separate violation.
