There are occasions when a duly appointed member or alternate
of the Village of New Hempstead Planning Board, Zoning Board of Appeals,
Architectural Review Board, Historic Preservation Commission or any
other board or commission cannot attend a meeting of said respective
board or, because of a conflict of interest, cannot vote on a matter
to be considered by said board, resulting in a lack of a quorum for
the conduct of business. It is the purpose of this article to permit
the Mayor, or in his absence, the Deputy Mayor, to appoint certain
officers as ad hoc members to attend such meeting and to vote in place
of such absent or disqualified member.
Notwithstanding the provisions of the Village Law, the Public
Officers Law or any other state law, the Mayor of the Village of New
Hempstead, or in his absence the Deputy Mayor of the Village, is hereby
authorized to appoint any one duly appointed member or alternate of
any board or commission of the Village as an ad hoc member of any
other board or commission that is or may be established by the Board
of Trustees, on the following conditions:
A. A duly appointed member of any of the aforesaid boards or commissions
advises the Mayor or the Deputy Mayor, as the case may be, prior to
a meeting of said board, that he/she will not be able to attend said
meeting or will not be able to vote on a matter that is scheduled
to be heard by said board because of a conflict of interest in connection
with an application.
B. The affected board will not be able to meet or to make a decision
on an application before it for lack of a quorum caused by the failure
of such member to attend and/or to vote.
The term of appointment of an ad hoc member appointed as set
forth hereinabove shall be for the specific meeting of the respective
board for which he/she has been appointed.
An ad hoc member of a board appointed by the Mayor or the Deputy
Mayor, as the case may be, pursuant to this article shall have all
of the powers and duties of the duly appointed member that he/she
is replacing for the meeting for which he/she has been appointed.
The Board of Trustees may, by resolution, provide for payment
of salaries to ad hoc members of boards on an hourly or per-meeting
basis.
