[Adopted as Ch. 2.20 of the 1979 Code]
The City Treasurer shall be elected and serve for a four-year
term and until his successor is elected and qualified as is provided
by statute.

Before entering upon the duties of his office, the City Treasurer
shall give a bond with sureties to be approved by the City Council
in an amount required by the City Council, said amount not to be less
than required by statute. The bond shall be conditioned upon the faithful
performance by the Treasurer of his duties, and to indemnify the City
for any loss due to any neglect of duty or wrongful act on the part
of the Treasurer. The City Treasurer shall receive such compensation
as may be from time to time provided by ordinance.

The Treasurer shall perform such duties as may be prescribed
for him by statute or ordinance. He or she shall receive all money
paid into the City, either directly from the person paying the money
or from the hands of other officers or employees as may receive it,
and he or she shall pay or cause to be paid all expenses of the City
authorized by the City Council.

The Treasurer shall deposit City funds in one or more financial
institutions designated as an authorized depository by the City Council
from time to time by resolution passed by the City Council. The City
Treasurer shall keep City funds separate and distinct from his or
her own funds and shall not intermingle his or her own funds with
the City funds or make private or personal use of the City funds.

A.
The Treasurer shall keep such records showing all money received
by him or her, the source from which it was received, and the purpose
for which it was paid out; and he or she shall keep records at all
times showing the financial status of the City.
B.
The City Treasurer shall keep all books, papers, vouchers, warrants,
documents and other written instruments pertaining to his or her office
at the City building, which books and documents shall be open to the
inspection of the Mayor, Council and the City Clerk.
C.
The Treasurer shall keep, in addition to the books of accounts provided
for in this section, such additional books of accounts as the Mayor
and Council from time to time direct.[1]

A.
The City Treasurer shall make a report, in person and in writing,
to the Mayor and Council at one regular meeting in each and every
month, showing all moneys that have been turned over to and received
by him or her from any and all persons, the disbursements, if any,
during the next preceding month, the funds to which those moneys in
his or her hands have been distributed, the separate items of each
account of the funds and the balance remaining, if any, in such funds.
B.
The Treasurer shall make an annual report, in writing, to the Mayor
and Council then file a copy of the annual report of receipts and
expenditures with the City Clerk, and after publication thereof shall
file a copy of same together with the Clerk's affidavit in the office
of the County Collector, in the manner provided by state statutes,
which report the City Clerk shall immediately cause to be published
as required by law.[1]

In case the office of City Treasurer shall become vacant for
any reason, it shall be filled by the Mayor with the advice and consent
of the Council as is provided by statute.

A.
The City Treasurer shall keep an account of each special assessment
under its general description and number, and the account shall show
at its head the amounts assessed for public benefits and special benefits.
B.
All moneys received on any special assessment shall be held by the
Treasurer as a special fund to be applied to the payment of the improvement
for which the assessment was made, and the money shall be used for
no other purpose, except as may be provided in the ordinance for the
improvement.

A.
Whenever the City Treasurer's term of office expires, whether by
resignation, removal from the City, removal from office or otherwise,
the Treasurer shall at once deliver to his or her successor in office,
or to such other person as may be specifically designated by resolution
of Council, all moneys, property, books and effects of every description
in his or her possession belonging to the City or pertaining to his
or her office.
B.
He or she shall also, at once, account for and pay over to such successor
or other person so designated all moneys that he or she is accountable
for and owes to the City in his or her capacity as Treasurer.
C.
Any person who, having acted as Treasurer, on the expiration of his
or her term of office, violates this section shall be liable for all
damage caused thereby.

A.
The City Treasurer shall keep all moneys belonging to the City that
are in his or her hands separate and distinct from his or her own
moneys, and he or she is expressly prohibited from using, either directly
or indirectly, any City moneys or warrants in his or her custody and
keeping it for his or her own use and benefit or for the use and benefit
of any other person.
B.
Any violation of this section shall subject the Treasurer to immediate
removal from office by the Mayor and Council.
C.
In the case of his or her removal, the Mayor and Council, voting
jointly, shall appoint a successor, who shall hold office for the
remainder of the unexpired term.
