A. 
Each user shall pay for the services provided by the City based on their use of the water system as determined by water meter(s) acceptable to the City.
B. 
All monthly user charges will be based on monthly water usage.
C. 
The minimum charge per month shall be twenty-six dollars and fifty-six cents ($26.56) for consumers inside City limits and twenty-nine dollars and ninety-three cents ($29.93) for consumers outside City limits. The minimum charge includes the first one thousand (1,000) gallons.
D. 
The user charge rates established in this Article apply to all users of the City's system, regardless of the user's location.

E. 
The following classes of users and monthly charges to these users are hereby established:

A. 
Fee Period. The Missouri State primacy fee as prescribed by the Missouri Department of Natural Resources and the Public Drinking Water Program will be included in the monthly bill. The fee will be collected monthly from September 1 through August 31 of each succeeding calendar year. This fee will be stated separately on the customer's water bill as a State fee.
B. 
Amount.
1. 
The charge assessed against each customer for each service connection of the City utility as established by the State is determined on the basis of meter size as stated below. The City shall use its records to determine the initial fee which, unless challenged within thirty (30) days, shall be conclusively presumed to be accurate.
a. 
For customers with a meter of one (1) inch or smaller: three dollars ($3.00/year).
b. 
Meters greater than one (1) inch but less than or equal to two (2) inches: seven dollars and forty-four cents ($7.44/year).
c. 
Meters greater than two (2) inches but less than or equal to four (4) inches: forty-one dollars and sixteen cents ($41.16/year).
d. 
Meter size more than four (4) inches: eighty-two dollars and forty-four cents ($82.44/year).
2. 
The customers served by multiple connections shall pay a monthly primacy fee based on the rates listed above for each connection, except that no single facility served by multiple connections shall pay a total of more than five hundred dollars ($500.00).
C. 
Collection. The City water system shall use all customary and regular rate collection practices when customers fail to pay the primacy fee by the due date, including imposition of a reasonable penalty and shutoff of water service to customer.
D. 
Remitting Fees To State. The fees collected shall be enumerated on a form provided by the Department of Natural Resources. The City of Marceline shall keep two percent (2%) of the fees remitted for the purpose of reimbursing its expenses for billing and collection of these fees.
E. 
Records To Be Kept. The City of Marceline water system shall preserve the books and records documenting the collection of fees from the customers for a period of at least three (3) years. The books and records documenting the collection of fees from the customers shall be subject to inspection by the appropriate State authority during business hours.

A. 
A financial adjustment to a residential customer's water utility bill related to a water leak or unexplained increase in water use may be approved by the City Manager under the terms and conditions of this Section.
1. 
The customer notifies the City of a water leak/unexplained increase in water charges and requests a leak adjustment.
2. 
Water consumption for the month in question is a minimum of one hundred percent (100%) greater than the average volume for the preceding twelve (12) months [excluding zero (0) consumption months].
3. 
Leak adjustments may occur only once in any twenty-four-month period and shall cover a single event only [although the single event adjustment may cover a maximum of two (2) monthly utility bills].
4. 
The adjustment request includes a plumber's repair receipt, City inspection or other proof that the problem has been resolved.
B. 
No adjustments shall occur when any of the following exist:
1. 
Excessive use is due to the customer's usage decisions such as seasonal use due to lawn watering, gardening, filling swimming pools/spas, etc.
2. 
Excessive use due to third party from whom customer is able to recover costs (theft, vandalism, construction damage, etc.).
3. 
Excessive water volume beyond the first two (2) months of a multi-month leak.
4. 
Leak adjustment has occurred for this property within the past twenty-four (24) months.
C. 
Adjustment Calculations. The adjusted bill shall charge the adopted water rates on all water volume used up to two (2) times the average monthly water use for this property (for each month involved in the leak).
1. 
Average water used shall be calculated using the past twelve (12) months excluding zero (0) balance months, divided by number of available months.
2. 
Customers with less than twelve (12) months of history will be calculated on an average use of three thousand five hundred (3,500) gallons per month.
