Article I Shared Equipment with City of Monongahela
The Borough of New Eagle, Pennsylvania, pursuant to the authority of the Pennsylvania Intergovernmental Cooperation Act, 53 Pa.C.S.A. § 2301 et seq., hereby elects to participate in a shared equipment and labor program with the City of Monongahela, Pennsylvania, upon the execution of the appropriate intergovernmental cooperation agreement.
The shared equipment and labor program shall provide for the sharing of both equipment and labor of the two municipalities under such terms as shall be stated in the appropriate intergovernmental cooperation agreement as adopted by each municipality. These terms shall include, but are not limited to, the payment of fuel costs by the municipality using the equipment, and receiving municipality's payment of the wages of the employees of the municipality supplying the labor.
The term of this intergovernmental cooperation agreement shall begin January 1, 2011, and shall continue until terminated by action of Borough Council.
The purpose and objective of the intergovernmental cooperation agreement shall be to realize cost savings and economies of a scale associated with such program to the benefit of the Borough of New Eagle and the City of Monongahela.
This shared equipment and labor program shall be administered by the governing bodies of the City of Monongahela, Pennsylvania and the Borough of New Eagle, Pennsylvania.
Each party to the intergovernmental cooperation agreement shall act autonomously in the management of its equipment and labor, and only the governing bodies of the parties shall have the ability to alter or amend the terms of the intergovernmental cooperation agreement.
Each party to the intergovernmental cooperation agreement shall provide all necessary liability insurance, equipment insurance, and workers' compensation insurance to protect its equipment when working in the other municipality through the intergovernmental cooperation agreement.
