The Borough of New Eagle, Pennsylvania, pursuant to the authority of 8 Pa.C.S.A. § 1202(5) of the Borough Code, hereby imposes a fine in the form of a fee upon the owner of any real property where fire equipment, fire trucks and/or other emergency equipment and vehicles of the New Eagle Volunteer Fire Department are dispatched as a result of a false alarm.
For the purposes of this chapter, a "false alarm" shall be defined as any request for emergency assistance where the actual need for emergency assistance does not exist.
The amount of the fine/fee imposed by the Borough of New Eagle under this chapter shall be in the amount of $100 and shall be payable to the Borough of New Eagle and received by the Borough of New Eagle within 20 days of the property owner's receipt of notice from the Borough of the fine/fee being imposed.
In the event that the imposed fine/fee is not received by the Borough of New Eagle within the time set forth above, the Borough shall have the right to proceed for the collection of such unpaid charge by an action in assumpsit or, at the election of the Borough, in any other manner provided by law for the collection of a municipal claim.
Any money collected by the Borough of New Eagle under this chapter shall immediately be paid over to the New Eagle Volunteer Fire Department, except for those costs incurred by the Borough of New Eagle in the collection of such charges.
