The purpose of this chapter is to provide for the establishment
of a Fee Schedule that incorporates a comprehensive listing of fees
charged by the City of Lapeer and to provide for the creation, amendment,
or discontinuance of fees charged by the City of Lapeer.

A.
The City Commission shall adopt an annual Fee Schedule.
B.
Adoption of the Fee Schedule shall be by motion.
C.
Fee Schedule to be named "City of Lapeer Fee Schedule."
D.
Effective date of the City of Lapeer Fee Schedule shall be July 1
of each year, with the exception of the first adopted Fee Schedule,
which shall take immediate effect.
E.
In the event the City of Lapeer Fee Schedule is not adopted by July
1 of each year, the previously adopted Fee Schedule, as amended, shall
remain in effect until such time as a new Fee Schedule shall be adopted
by the City Commission.
Amendments to the adopted City of Lapeer Fee Schedule shall
be made by motion of the City Commission.
Each department, office, or other administrative unit of the
City of Lapeer may, subject to authorization by the City Commission,
create, amend, or discontinue user fees or regulatory fees in connection
with their department, office, or other administrative unit. Each
fee so created, amended, or discontinued shall be authorized by amending
the City of Lapeer Fee Schedule.
In the event that an ordinance conflicts with the Fee Schedule
regarding the existence or amount of a fee, the ordinance shall control.
If any section, paragraph, clause, phrase or part of this Fee
Schedule Ordinance is for any reason held invalid by any court of
competent jurisdiction, such decision shall not affect the validity
of the remaining provisions of this chapter; and the application of
those provisions to any persons or circumstances shall not be affected
thereby.
This chapter shall become effective on the date of publication.
