(A) 
There shall be established a Personnel Review Committee which shall consist of three members: the Mayor, and one Alderman and one department head, or two Aldermen. The Mayor shall serve as Chairman of the Personnel Review Committee. The Aldermen and/or the department head who serve as members of the Personnel Review Committee shall be appointed by vote of the Aldermen. This Committee will be charged with the overseeing and monitoring of all personnel rules and regulations and the enforcement of same. In arriving at decisions on policy, the Committee may consult with the Council, department heads, the City Attorney, or others whose expertise may bring light to a specific area involving personnel procedures.
(B) 
It is the policy of the City that the following principles be adhered to:
(1) 
All appointments shall be made on the basis of merit and fitness for public service and in compliance with the statutory or ordinance provisions that may apply.
(2) 
Hiring practices will conform to the Affirmative Action Program adopted by the City on October 26, 1976, Ordinance No. 6-1976. See § 1.114 of the City Code.
(3) 
All employees are entitled to prompt and fair adjustment of grievances. Notwithstanding, all employees may be terminated or suspended without notice, a hearing, or assigning cause.

The provisions of §§ 2.140 to 2.199 of this chapter shall apply to all City personnel, except where the provisions herein are inconsistent, are modified by the section of this chapter pertaining to the Police Department and to the rules and regulations or state law applicable to members of the Police Department.
(A) 
All employees shall be hired by the department head with the approval of the City Council. All employees may be discharged by the department head.
(B) 
All hiring shall be performed following the guidelines of City ordinance, including affirmative action and residency requirements.
(C) 
Any employee discharged for a reason other than reduction of personnel may file a written petition with the City Council within 48 hours after his discharge, stating the reason he feels the discharge is unfair. If a petition is filed, the City Council shall conduct a closed meeting with the employee and the person responsible for the firing present. Witnesses and counsel may be present. At this meeting, the City Council shall hear whatever either party wishes to state. The Aldermen may override a discharge by a majority vote at the next regular meeting of the City Council, if they so see fit.
(D) 
Nothing in this chapter establishes any right to employment by the City, nor any tenure, civil service or right to notice and a hearing prior to termination or suspension. All employees may be terminated with or without cause. All employees hold their employment subject to the provisions of this section.
City employees shall observe, obey and carry out the orders and directions solely of the head of the department in which they are employed.
