As used in this article, the following terms shall have the
meanings indicated:
FOOD DISPENSER
Any person who keeps for sale, sells, and serves to the public
for consumption on the premises or on the public way contiguous to
said premises, or any mobile vehicle or stand on the premises or public
way, any article of food or drink for human consumption. Restaurants,
coffee houses, lunch rooms, tea rooms, lunch stands, box lunch deliveries,
luncheonettes, cafeterias, and retail drugstores serving counter lunches
and drinks shall be included among food dispensers.
SERVICE
The placing of such food for the convenience of the patron
into any cup, glass, dish, plate, or other receptacle from which the
patron may conveniently consume it.
It shall be unlawful to engage in the business of a food dispenser
without first obtaining an annual license therefor.
Application for such licenses shall be made to the City Clerk and shall be referred to the Health Officer for such inspections as may be necessary to see that the provisions of this article are complied with. The annual fee for such license shall be based on the square foot area requirements of §§
11.16 and
11.17.
Any food dispenser's license may be revoked by the Mayor after
hearing and notice to the licensee for repeated violation of the provisions
of this article, or for any violation of any ordinance provisions
relating to the conduct of the business, the condition of the premises,
the articles sold or to the license required.
