This article is enacted to enhance the beauty and cleanliness of the streets, sidewalks, parks and other public property of the Village of Fonda, by enforcing certain regulations and restrictions on the activities of animals.
Any person owning or in charge of any dog which soils, defiles, defecates on or commits any nuisance on any common thoroughfare, sidewalks, passageway, play area, park or any place where people congregate or walk or upon any private property without the permission of the owner of said property shall immediately remove all feces deposited by any such dog in a sanitary manner.
The feces removed from the aforementioned designated areas shall be disposed of by the person owning or in charge of any such dog in a sealed nonabsorbent leakproof container. In no event shall any feces be deposited in sewers or drains whether storm or sanitary.
This provision of this article shall not apply to blind persons who may use dogs as guides.
Any person who violates or neglects to comply with any provision of this article shall, upon conviction, be punishable by a maximum fine of $250 or by imprisonment for not more than 15 days, or both.

This article may be enforced by any law enforcement or by any person appointed by resolution of the Board of Trustees.
