The Village hereby prohibits the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance on any property owned by the Village or in any workplace under the control of the Village.
Employees who violate the prohibition in § 66-1 shall be subject to the following:
A. 
Employees must notify their employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such conviction.
B. 
Within 30 days of receiving notice of any criminal drug statute conviction for a violation occurring in the workplace, this employer will take appropriate personnel action against such employee, up to and including termination; or
C. 
Within 30 days of receiving notice of any criminal drug statute conviction for a violation occurring in the workplace, this employer may require such employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a federal, state or local health, law enforcement, or other appropriate agency.
The Village hereby establishes a drug-free awareness program to inform employees about the dangers of drug abuse in the workplace, the policy of the Village maintaining a drug-free workplace, advice concerning available drug counseling rehabilitation and employee assistance programs and the penalties which may be opposed upon employees for drug abuse violations occurring in the workplace. Each employee of the Village is to be furnished a copy of this article by the Village Clerk within the first 30 days of each succeeding fiscal year and within the first seven days of employment by the Village.
Each employee upon entering into employment with the Village and each employee presently employed by continuing employment with the Village shall, as a condition of their employment, abide by the provisions of §§ 66-1 and 66-2 of this article and also shall notify the Village of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such conviction.[1]

Within 30 days of receiving notice under § 66-4 with respect to any employee who is convicted of violating a criminal drug statute, the Village shall take appropriate personnel action against such employee, up to and including termination, according to the standards provided in §§ 66-1 and 66-2 of this article or the Village shall require such employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a federal, state, or local health, law enforcement, or other appropriate agency.
The Village shall make a good faith effort to continue to maintain the drug-free workplace provided through implementation of all of the sections of this article.
Notice of this article shall be served on all employees, and each employee shall be requested to certify compliance with this article.

Any person who violates any terms of this article shall, upon conviction thereof, in addition to all other penalties provided by this article, be subject to penalties as set forth in Chapter 1, Article III, of the Village Code.
