The establishment or use for purposes of burial or interment of any new cemetery or burying ground in addition to those now existing within the limits of the Borough of Darby, County of Delaware and State of Pennsylvania, at any time hereafter is hereby prohibited.
The enlargement of the existing cemeteries or burying grounds within the limits of the Borough of Darby, County of Delaware and State of Pennsylvania, by adding thereto or using for the purpose of burial or interment ground not now owned by the owner of such cemeteries or burying grounds respectively, is hereby prohibited.

The burial or interment of any human body in any place within the Borough of Darby, County of Delaware and State of Pennsylvania, except in grounds now used as a cemetery or burying ground or without compliance with any applicable health laws, rules or regulations of said Borough, is declared to be a nuisance and is hereby prohibited.

Any person who shall violate any provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $300 and costs of such proceedings or, upon default of payment of such fines and costs, by imprisonment in the county jail for a term of not more than 30 days. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
