No minor child under the age of 18 years shall go, or be abroad,
upon any of the public streets, highways, alleys, parks or other public
places of the Township of Lower Swatara after the hour of 11:00 p.m.;
provided, however, that the foregoing shall not apply, if:
A.
Such minor child is accompanied by his or her parent, guardian or
other person having legal care or custody of the child, or by a person
of good repute over the age of 21 years of age.
B.
Such minor child, under the direction of his or her parent, guardian
or other person having legal care or custody of the child, is in the
performance of an errand or duty.
C.
Such minor child has bona fide employment which makes it necessary
for him or her to be upon public streets, highways, alleys, parks
or other public places after the hour of 11:00 p.m.

It shall be unlawful for a parent having legal custody of a
minor knowingly to permit or by inefficient control to allow, such
minor to be or remain upon any Township street under circumstances
not constituting an exception to or otherwise beyond the scope of
this Part. The term "knowingly" includes knowledge which a parent
should reasonably be expected to have concerning the whereabouts of
a minor in that parent's legal custody. It is intended to continue
to keep neglectful or careless parents up to a reasonable community
standard of parental responsibility through an objective test. It
shall, a fortiori, be no defense that a parent was completely indifferent
to the activities or conduct or whereabouts of such minor.

In the event that a minor child under the age of 18 years is found by the police officers of the Township in or upon any of the public streets, highways, alleys, parks or other public places of the Township, in violation of the provisions of § 6-401, the police officer shall take the name of such minor child, together with the name and address of the parent, guardian or other person having legal care or custody of such child, and shall thereafter return the child to his or her home. The police officer shall, within 24 hours, make a report of the circumstances to the Chief of Police of the Township, thereupon the Chief of Police shall send a notice, in writing, to the parent, guardian or other person having legal care or custody of the child acquainting that person with the circumstances constituting a violation of §§ 6-401 and 6-402, including a warning that a second violation will result in prosecution of the parent, guardian or other person having legal care or custody of the minor child.

Any parent, guardian or other person having legal care or custody of a minor child, as herein defined, who shall violate this Part, after receipt of the written notice provided by § 6-403 hereof, shall be, upon conviction thereof, sentenced to pay a fine of not less than $25 nor more than $600 plus costs and, in default of payment said fine and costs, to a term of imprisonment not to exceed 30 days.

The curfew hour of 11:00 p.m., prescribed by § 6-401 hereof, shall be daylight savings time during such part of the year when daylight saving time is observed generally in the Township.
