The Township government shall include the statutory, legislative,
judicial, advisory and independent boards, agencies, commissions and
committees described in this article. The administrative functions,
powers and duties of these statutory and independent boards, commissions,
committees and agencies of the Township government shall be subject
to the supervision of the Mayor and Business Administrator, except
as otherwise specifically required by the Charter, Code or other statutory
law.

A. Formation; composition; terms; vacancies; compensation.
(1) There is hereby created the Mine Hill Township Housing Board, which
shall consist of five members appointed by the Township Council. At
least one member shall be a member of the Township Council or the
Mayor.
(2) The term of the member of Township Council shall correspond to his
official tenure. The terms of the remaining members shall be four
years, computed from the first day of January of the year of appointment,
provided that the terms of such members are staggered so that one
term expires each year. If a vacancy occurs among such members, it
shall be filled for the unexpired term only. Members shall serve after
the expiration of their terms until their successors have been appointed
and qualified.
(3) Members shall serve without salary.
B. Officers. The Mine Hill Township Housing Board shall elect a Chairman
and a Vice Chairman from among its members. Their terms of office
shall be one year, and they shall be eligible for reappointment. The
Board shall also elect a secretary, who may but need not be a member
of the Board, and it may create and fill such other offices as it
shall determine.
C. Staff and consultants. The Mine Hill Township Housing Board may employ
or contract for and fix the compensation of such experts and other
staff and services as it deems necessary. Obligations for the foregoing
shall not exceed, exclusive of gifts and grants, the amounts agreed
upon and appropriated for the Board's use. Costs for such services
shall be borne by the developer of the low- and moderate-income project.
D. Powers and duties. The Mine Hill Township Housing Board shall have
the powers and duties established by this section.
E. Operation of the low- and moderate-income housing program. The following regulations shall apply to the lower- and moderate-income units produced pursuant to §
310-169, Residential Affordable Housing Zone (RAH), to the extent not inconsistent with the laws regulating them:
(1) Sales prices. The initial sales prices (including such fees and charges
as are imposed on the buyer by the seller) shall not exceed to be
applicable maximums established from time to time by written regulation
of the Mine Hill Township Housing Board. No separate parking fee (other
than for trailers and mobile homes) shall be charged, and any fees
for use or recreational facilities shall not be charged greater than
those charged owners of the non-low- and moderate-income units.
(a)
The Mine Hill Township Housing Board shall establish and periodically
revise sales price levels for the low- and moderate-income units in
order that such units are affordable to low- and moderate-income households
and may vary the sales prices on the basis of the type of structure,
the floor area, number of bedrooms in the unit, and other relevant
factors.
(b)
The sales prices shall be set so that units shall be affordable
not only by households at the ceiling income for low-income households
and moderate-income households respectively, but by a reasonable cross
section of households within each category. The sales prices shall
be set so as to be affordable to households with incomes between 40%
and 50% of the median, for low-income households, and between 65%
and 80% of the median, for moderate-income households. Maximum sale
prices shall be established based on the following assumptions on
occupancy of units by household size:

(2) When establishing sales prices for resale of the low- and moderate-income
units, the Mine Hill Township Housing Board shall assure that the
units remain affordable to low- and moderate-income households if
they initially were low-income units and moderate-income households
if they initially were moderate-income units and shall limit price
increases to the household income in the region in which Mine Hill
Township is located or in such other manner as will assure continued
availability of the units to low- and moderate-income households and
a fair return to the homeowner. In addition, the Board shall by regulation
provide for the manner and extent to which out-of-pocket costs of
closing and the value of reasonable improvements are recoverable by
the homeowner upon sale and the manner in which needed repairs are
made or paid for by the owner. It may establish procedures whereby
homeowners can secure certification of improvements in advance of
their construction, in which case the homeowner shall recover the
value of same at the time of sale.
(3) The Mine Hill Township Housing Board may grant exceptions to the
sales and rent ceilings established by this section when peculiar
circumstances associated with a low- and moderate-income unit make
such ceilings impracticable or otherwise inappropriate.
F. Eligibility.
(1) The lower-income units shall be sold only to persons who meet the
eligibility standards established by written regulation of the Mine
Hill Township Housing Board for ownership of such units and who are
certified by the Board as eligible. Necessary costs related to qualifying
and processing applications of prospective residents shall be borne
by the developer of the low- and moderate-income project.
(2) The Mine Hill Township Housing Board shall establish and periodically
revise eligibility standards for the low- and moderate-income units
in order that only low- and moderate-income households are eligible
therefor and shall establish standards relating to maximum level of
assets.
G. Sales procedures and standards.
(1) The Mine Hill Township Housing Board shall by regulation establish:
(a)
Procedures providing for notification to it and to eligible
households in the order and manner as it sees fit where low- and moderate-income
units become available for sale;
(b)
Procedures to assure that the low- and moderate-income units
are sold only to persons eligible therefor in light of applicable
eligibility, preference, and priority standards, that households entitled
to a preference or priority are given a reasonable opportunity to
utilize same, and that the Board is notified of the persons to whom
the units are sold; and
(c)
Such other procedures and policies pertaining to sales which
it deems necessary to fulfill the purposes of this section.
(2) Persons who reside or have resided or are employed in the Township
and live in substandard or overcrowded housing shall be given a preference
over other persons for the low- and moderate-income units available
for sale. The Mine Hill Township Housing Board may establish priorities
among persons afforded a preference and such other priorities as it
deems appropriate, and not to exceed 15% of the low- and moderate-income
units within the project.
(3) In no event shall an owner be required to offer a low- and moderate-income
unit for sale through the Mine Hill Township Housing Board for more
than 60 days from the date it becomes available for purchase. If during
such time period an eligible household does not make an offer to purchase
meeting the terms upon which the offer to sell was made, the owners
may sell the unit to any household meeting the eligibility standards
established by the Board, and the sales controls established herein
shall continue to apply.
H. Right of first refusal of the Mine Hill Township Housing Board. The
Mine Hill Township Housing Fund shall have an assignable right of
first refusal to purchase any low- or moderate-income unit being offered
for resale, exercisable within 60 days after the unit is first offered
for sale.
I. Restrictions on use. Every purchaser of a low- or moderate-income
unit shall use it for his/her own primary residence and shall certify
on a form prescribed by the Mine Hill Township Housing Board that
he/she is acquiring the unit as his/her or his/her family's primary
place of residence.
J. Duration of sale and rent controls; termination of controls by owner
buyout.
(1) Durational controls on sales for each low- or moderate-income unit
shall be established by the Mine Hill Township Housing Board and shall
be of the longest possible duration consistent with regulatory, financing,
and other relevant requirements.
(2) The owner of a low- or moderate-income unit subject to resale or
rental controls may terminate such controls by transferring to the
Mine Hill Township Housing Board an amount established by the Board
in light of the difference in the fair market value of the unit with
and without the controls and other relevant factors. The Board in
its discretion may refuse to accept the amount offered and to terminate
the controls if it determines that another low- or moderate-income
unit cannot be secured for the amount offered or less.
K. Foreclosure regulations. Notwithstanding the foregoing provisions,
the Mine Hill Township Housing Board is authorized to establish written
regulations dealing with foreclosure proceedings, subject to approval
by the governing body.
L. Other functions of the Mine Hill Township Housing Board. In addition
to exercising the powers set forth hereinabove, the Mine Hill Township
Housing Board:
(1) May adopt regulations governing provision of financial assistance
and design and other technical assistance to small lot program applicants
and provide such assistance;
(2) May adopt regulations governing provision of financial assistance,
including down payment to purchasers of the low- and moderate-income
units, and provide such assistance;
(3) May provide financial and technical assistance to nonprofit organizations
organized to provide low- and moderate-income housing in the Township;
may solicit and receive loans, grants, and contributions from all
sources to further the purposes of this section;
(4) May recommend to Township Council and the Planning Board modifications
of this section to increase the workability of this section;
(5) Shall report annually to Township Council and the Planning Board
on the operation of the affordable housing program established by
this section;
(6) Shall monitor applicants' activities for compliance with the
agreements submitted as part of final approval and with this division
and regulations issued hereunder;
(7) Shall take such other steps as will maximize the production of lower-
and moderate-income housing pursuant to this section;
(8) May contract for services from and delegate functions to the Mine
Hill Township Housing Board, except that it may not delegate its power
to adopt regulations pursuant to this section.
M. Mandatory program revaluation. If after the effective date of the
adoption of this section, there is legislation or judicial decisions
which revise the requirement for municipalities to provide for affordable
housing, including the phasing of same, then the provisions of this
section shall be forthwith reviewed by the Mine Hill Township Planning
Board and Township Council to ensure that the provisions of this section
comply with the then-current legal requirements with regard to affordable
housing.
N. Executive regulations. The Mine Hill Township Housing Board shall,
from time to time, issue such written regulations as may be necessary
to implement and administer the provisions of this section.

A. Establishment. There is created a Beach Committee which shall consist
of up to 11 members. Up to 10 of the members shall be appointed by
the Mayor with the advice of the Council. One member shall be a member
of the Council appointed by the Council. All members shall be appointed
annually to serve for a one-year term.

B. Beach Director. The Mayor with the advice and consent of Council
may appoint a Beach Director, which shall serve for a period of one
year beginning on January 1 of each year, with salary to be established
by the Township Council.
C. Chairperson; other officers. The Beach Committee shall appoint a
Chairperson and such other officers as may be necessary and appropriate.
D. Duties and responsibilities. The Beach Committee shall serve as an
advisory committee to the Council and administration and shall advise
the Council and administration concerning the operations of the Mine
Hill Beach.

E. The Beach Committee shall commence operations as of January 1, 1992.

A. Established.
There is hereby established a Mining Review Board for the location,
documentation and review of mining monuments which have been placed
on various tracts throughout the Township. The Mining Review Board
will also maintain a database regarding the aforementioned information
collected and generate correspondence to keep said database current
and provide said information to the Township Council and the Township
Planning Board.
B. Definitions.
As used in this section, the following terms shall mean and include:
BOARD
The Mining Review Board.
COUNCIL
The Township Council of the Township of Mine Hill.
C. Membership;
qualifications; terms.
(1) The Board shall consist of three qualified persons appointed by the
Mayor with the advice and consent of the Council.
(2) The individuals may be members of the Planning Board. Board membership
may also include other persons who have demonstrated special interest,
knowledge or experience in mining monuments or a related discipline.
(3) The term of office shall be five years; however, so that the expiration
of appointments will be distributed evenly over a five-year period
of time, the appointments should be made in the following manner:
of the original members, one member shall be appointed for a term
of three years; one member shall be appointed for a term of four years;
and one member shall be appointed for a term of five years. The term
of each member shall expire on December 31 of the last year of each
member's term and upon the appointment and qualification of such member's
successor. The terms of appointment of succeeding Board members shall
be for five years each, to expire December 31 of the last year of
the term, and upon the appointment and qualification of such member's
successor. Members shall be exempt from any provisions of any other
ordinances of the Township limiting the number of terms that a member
of the Board may hold. A member of the Board may serve for as many
succeeding terms as such member may be appointed to by the Mayor with
the approval of the Mayor and Council.
D. Salary;
staff; financial support; volunteers.
(1) Members of the Board shall serve without pay.
(2) The Board shall have such staff as shall from time to time be assigned
to the Board by the Mayor and Council as they deem necessary. Expenditures
shall not exceed, exclusive of gifts or grants, the amount appropriated
by the Council for the Board's use.
(3) The Mayor and Township Council shall annually allocate funds within
budget limitations for the operation of the Board. The Board shall
endeavor to avail itself of financial assistance from federal, state,
or private sources.
(4) The Board shall use volunteers, to the maximum extent possible, to
obtain information, to disseminate information, to locate and research
mine monuments and to perform all of the functions of the Board in
the most effective way possible.
E. Officers.
The Board shall elect from among its members a Chairman, a Vice Chairman,
and a Secretary. These officers shall serve for such term of office
as shall be designated by the Board. No officer's term of office shall
be shortened during that officer's term of office. The Chairman shall
preside at meetings, and the Vice Chairman shall preside in the absence
of the Chairman.
F. Removal
and vacancies; records; meetings; quorum.
(1) Any member, after a public hearing, if requested by the member, may
be removed from the Board by the Township Council for cause.
(2) A vacancy occurring otherwise than by expiration of term shall be
filled by an individual appointed by the Mayor with the advice and
consent of the Council and shall serve for the unexpired term only.
(3) The Board shall keep minutes and records of all meetings and proceedings,
including voting records, attendance, resolutions, findings, determinations
and decisions. All such material shall be public record. All meetings
shall comply with the Open Public Meetings Act. No Board member shall vote or participate in any meeting
concerning any matter in which he has a direct or indirect personal
interest, monetary or otherwise.
(4) A quorum for the transaction of business shall consist of two of
the Board's members, including the Chairman, or in his absence, the
Vice Chairman.
G. Powers and
duties. The Mining Review Board shall perform all of the functions
assigned by federal law, state law or Township ordinances to the Board.
H. Documentation
and review of mining monuments.
(1) The Board should survey the entire Township to locate and identify mining monuments and prepare records of same to ensure compliance with the provisions of §
310-182B(3). Any noncompliance should be recorded and the governing body should be notified of same as well as the Township Planning Board.
(2) The Board should update the mining database upon receipt of any new
information.
I. Custodial
care of records.
(1) The Board shall maintain current lists of all documented mining monuments.
(2) The Board shall also act as custodian of the mining activity database
as contained in the Abandoned Iron Mines of Mine Hill prepared by
Memo Agreement No. 14-09-0050-3507 with the Department of Mines.
J. Interaction
with Township boards and commissions. The Board shall work in close
association with a mining consultant, the municipal governing body
and the Planning Board to facilitate measures to rehabilitate mines.
The Board shall also act as an advisor to these and other municipal
boards and commissions.
K. Annual update.
The Board must report at least twice annually to the Mayor and Township
Council on the state of mining monuments in the Township and the measures
the Board has taken to abide by the duties assigned to it by this
section.
L. Fees shall be imposed upon the applicant for development pursuant to §
310-254 of Chapter
310, Land Use, of the Code of the Township of Mine Hill.

A. Creation
of Mine Hill Sewer Commission. There is hereby established a Sewer
Commission responsible for the general management, planning and financial
aspects of the installation of the sewer system in the Township of
Mine Hill.
B. Definitions.
As used in this section, the following terms shall mean and include:

C. Membership;
appointment; terms.
(1) The Commission shall consist of five full members and two alternate
members.
(2) The Council shall appoint three full members and one alternate member.
The Mayor will appoint two full members and one alternate member.
(3) The term of office shall be three years for full members; however,
so that the expiration of appointments will be distributed evenly
over a three-year period of time, the appointments should be made
in the following manner: of the original members, two full members
shall be appointed for a term of two years, and one full member shall
be appointed for a term of one year. Each alternate member shall serve
a term of one year. The term of each member shall expire on December
31 of the last year of each member's term and upon the appointment
and qualification of such member's successor. The terms of appointment
of succeeding Commission members shall be for three years each, to
expire December 31 of the last year of the term and upon the appointment
and qualification of such member's successor. Members shall be exempt
from any provisions of any other ordinances of the Township limiting
the number of terms that a member of the Commission may hold. A member
of the Commission may serve for as many succeeding terms as such member
may be appointed to by the Mayor and Township Council.
D. Salary;
staff; financial support; volunteers.
(1) Members of the Commission shall serve without pay.

Chairman, and a Secretary. Theses officers shall serve for a term
of one year. No officer's term of office shall be shortened during
that officer's term of office. The Chairman shall preside at meetings,
and the Vice Chairman shall preside in the absence of the Chairman.
The Secretary shall prepare minutes of meetings which shall be duly
certified by said Secretary.
F. Removal
and vacancies; records; meetings; quorum.
(1) The Township Council may remove any member of the Commission for
cause on written charges served upon such member and after a hearing
thereon, at which hearing the member shall be entitled to be heard
in person or by counsel.
(2) A vacancy occurring otherwise than by expiration of term shall be filled in accordance with Subsection
C(2) of this section. Said replacement shall serve for the unexpired term only.
(3) The Commission shall keep minutes and records of all meetings and
proceedings, including voting records, attendance, resolutions, findings,
determinations and decisions. All such material shall be public record.
All meetings shall comply with the Open Public Meetings Act (N.J.S.A.
10:4-6 et seq.). No Commission member shall vote or participate in
any meeting concerning any matter in which he has direct or indirect
personal interest, monetary or otherwise.
(4) A quorum for the transaction of business shall consist of three of
the Commission's members.
G. Powers and
duties. The Sewer Commission shall establish rules and procedures
for conducting the business of the Commission and shall perform all
of the functions assigned by federal law, state law or Township ordinances
to the Commission.
H. General
management of sanitary sewer system operations.
(1) The Commission shall investigate and record all sewer service complaints
and sewer infrastructure problems and report same to the proper authority.
The Commission shall monitor the correction of the aforementioned
complaints and problems, ensuring an expedient resolution of same.
(2) The Commission shall maintain communications with all agencies involved
in the proper functioning of the sanitary sewer system.
(3) The Commission, with the authorization of the Mayor, shall seek and
secure additional sewer gallonage.
(4) The Commission shall seek sources of available funding for the installation
and rehabilitation of sanitary sewers.
(5) The Commission shall prepare a monthly report of all activity mentioned
in this section to the Township Council and Administrator.
I. Sewer Commission
planning.
(1) The Commission shall be responsible for research, review and maintenance
of current geological maps depicting areas of reported septic malfunction
on a block and lot basis, and the dates of said malfunctions.
(2) The Commission shall maintain maps of all lots located within 200
feet of sewer lines and those actually connected into the sewer infrastructure.
(3) The Commission shall track capacity rate allocation and current connections.
(4) The Commission shall monitor planned projects and develop a priority
ranking for future projects.
(5) The Commission shall update and maintain a five-year sewer plan on
an ongoing basis.
(6) The Commission shall prepare a monthly report of all activity mentioned
in this section to the Township Council and Administrator.
J. Monitoring
of sewer connections and assessments.
(1) The Sewer Commission will be responsible for monitoring sewer connections
and will prepare letters to parties where connections are required
for processing by the Council.
(2) The Commission will request and receive applications for advance
reservation fees.
(3) The Commission will research and recommend to the governing body
any reimbursements that may be considered reasonable.
(4) The Commission, upon specific authorization of the Council, will
research and recommend assessments for individual lots within new
project service areas.
(5) The Commission shall prepare a monthly report of all activity mentioned
in this section to the Township Council and Administrator.
K. Annual update.
Aside from the monthly reports required above, the Commission must
report in writing at least once annually to the Mayor and Township
Council on the state of the sewer system in the Township and the measures
the Commission has taken to abide by the duties assigned to it by
this section.

A. Establishment of Utility. A Municipal Sewer Utility is established
for the regulation and operation of the Township wastewater collection
system to ensure proper operation, protection and preservation of
the wastewater collection system, to fix the amount and charges and
to provide rules and regulations for the use of the system. The Township
wastewater collection system, and all extensions and improvements
thereof, located in, constructed or acquired at public expense by
the Township of Mine Hill shall be operated under the direction and
control of the Mayor and Council as a publicly owned municipal sewer
utility. For accounting purposes, the Sewer Utility shall be a separate
entity with its own borrowing capacity, separate accounts, and its
own separate property, whether real, personal or mixed, within the
meaning of N.J.S.A. 40A:26A-1 et seq., and any amendments thereof
or supplements thereto, and the provisions of all other applicable
laws.
B. Title. The Municipal Sewer Utility shall be known as the "Township
of Mine Hill Municipal Sewer Utility (TOMHSU)."
C. Powers and authority. The Township of Mine Hill Municipal Sewer Utility
shall have the following powers and authority:
(1) To acquire, construct, improve, extend, enlarge or reconstruct and
finance sewerage facilities in the Township of Mine Hill and beyond,
and to operate, manage and control all or part of the facilities and
properties related thereto.
(2) To issue bonds to pay all or part of the cost of the purchase, construction,
improvement, extension, enlargement or reconstruction of the system.
(3) To receive and accept grants or loans from the federal or state government,
or any agency or instrumentality thereof, for or in aid of planning,
purchase, construction, improvement, extension, enlargement or reconstruction
or financing of sewerage facilities, and to receive and accept from
any source contributions of money, property, labor or other things
of value to be held, used and applied only for the purposes for which
the grants, loans or contributions are made.
(4) To acquire in the name of the Township lands, and rights and interests
in lands, located within or outside of the borders of the Township,
by gift, purchase or by exercise of the right of eminent domain, including
lands under water and riparian rights, and such personal property
as may be deemed necessary for acquisition, construction, improvement,
extension, enlargement or reconstruction, or for the efficient operation
of any facilities acquired or constructed, and to hold and dispose
of any and all real and personal property so acquired.
(5) To make and enter into all contracts and agreements necessary or
incidental to the performance of its duties and the execution of powers
authorized by law, and to employ engineers, superintendents, managers,
attorneys, financial or other consultants or experts, and other employees
and agents, as may be deemed necessary to and fix their compensation.
(6) Subject to the provisions and restrictions set forth in this section
authorizing or securing any bonds issued, to enter into contracts
with the federal or state government, or any agency or instrumentality
thereof, or with any other local unit, private corporation, copartnership,
association or individual providing for, or relating to, sewerage
services, which contracts may provide for the furnishing of sewerage
facility services either by or to the Township, or the joint construction
or operation of sewerage facilities.
(7) To fix and collect rates, fees, rents and other charges in accordance
with law.
(8) To prevent toxic pollutants from entering the sewerage system.
(9) To exercise any other powers necessary or incidental to the effectuation
of the general purpose for which it was created.
D. Management of the Township Sewer Utility.
(1) The Township of Mine Hill Municipal Sewer Utility shall be operated
under the direction and control of the Mayor and Council of the Township
of Mine Hill, which shall establish all policies for the operation
thereof.
(2) The Township Administrator shall be the chief executive and administrative officer of the TOMHSU and shall manage and oversee all of its administrative and operating affairs. The Administrator shall have the authority to operate the TOMHSU as set forth in Chapter
7 of the Mine Hill Code and applicable statutes authorizing the Township of Mine Hill's form of government.
(3) The Township Administrator shall, from time to time, appoint such
employees and other personnel as the Administrator shall deem necessary
for the proper administration of the business of the TOMHSU in accordance
with the budget adopted by the Mayor and Council.
(4) The salary of all employees of the TOMHSU shall be in such amount
as fixed by a salary ordinance as amended from time to time.

A. Establishment. There is hereby established an Open Space Committee
consisting of nine members appointed by the Mayor and Township Council.
B. Membership. All members of the Open Space Committee shall, with the
exception of the Township Planner, be residents of the Township and
serve without compensation. The Open Space Committee shall be comprised
of the following persons:

(3) One member of the Township Council.
(4) Two residents of the Township who may be, but are not required to
be, members of the Environmental Commission selected by the Township
Council.
(5) One member of the Planning Board to be designated by the Mayor.
(6) One member of the Mining Review Board to be designated by the Mayor.
(7) Two members who are residents of the Township to be appointed by
the Township Council.
(8) The Committee shall have the right to appoint nonvoting advisory
members with special abilities and expertise beneficial to the objectives
of the Committee.
C. Terms of office. The terms of office for the members of the Committee
shall be as follows:
(1) The Mayor, members of the Township Council, Environmental Commission,
Planning Board and Mining Review Board shall have terms which shall
correspond to the terms of their respective positions, elective or
otherwise.

(2) The Township Planner shall serve as a member of the Open Space Committee
as long as he/she is employed by the Township in capacity of Township
Planner.
(3) One resident member appointed by the Township Council shall serve
three years.
(4) One resident member appointed by the Township Council shall serve
two years.
D. Powers, functions and responsibilities of the Committee. The Open
Space Committee shall have the following powers and responsibilities:
(1) The Committee shall make an annual determination of which parcels
of land are recommended for acquisition with funds from the Open Space
Trust and the recommended method of acquisition, including but not
limited to the following:
(a)
By the acquisition of developmental rights;
(b)
By outright purchases in fee simple;
(d)
By the acquisition of conservation easements;
(e)
By the acquisition of scenic easements;
(f)
Through the use of trust funds as a down payment for the issuance
of bonds to acquire open space;
(h)
By other methods for the same purposes, at the discretion of
the Township Council.
(2) The Committee shall submit to the Township Council a prioritized
list of properties to be acquired and/or properties for which developmental
rights should be acquired. The Township Council, utilizing the prioritized
list submitted by the Committee, shall determine annually which parcels
shall be acquired and the amount to be appropriated annually for the
open space purposes.
(3) The Committee shall investigate and report to the Township Council
additional funding sources to supplement the Township of Mine Hill
Open Space Trust Fund.
(4) The Committee shall prepare or assist in the preparation of grant
proposals to obtain additional funding.
(5) The Committee shall develop, in cooperation with the Planning Board,
an open space plan for use in the "open space element" of the Township's
Master Plan.
(6) The Committee shall advise the Township Council and Mayor on any
issues relating to use and acquisition of open space.
(7) The Committee shall submit a budget request for operating expenses
to the Mayor during November of each year to be included in the subsequent
year's municipal budget.
(8) The Committee may employ and/or contract for professional services
by appraisers, legal counsel, or other professionals staff as it may
deem necessary, subject to appropriations and the Township Council's
passage of professional services resolutions establishing the rates
of compensation to be paid.
(9) The Committee shall hold public meetings, which public meetings shall
be held in accordance with the Open Public Meetings Act, and the Committee
shall give appropriate notification of said meetings.
(10) The Committee shall hold no fewer than 10 regular meetings annually,
and the dates and times of such meetings shall be determined and established
at the first regular meeting.
(11) The Committee shall elect from among its members, exclusive of the
Township Planner, a Chairperson to preside over the meeting and business
of the Committee, a Vice Chairperson to serve as the presiding officer
in the absence of the Chairperson, and a Secretary to maintain agendas
and minutes of the Committee meetings, and otherwise be responsible
for the records and correspondence of the Committee. The Committee
may adopt such bylaws or rules of procedure as it may deem appropriate
to govern the conduct of its affairs.

A. Establishment; composition; terms; organization. The Community and
Recreation Advisory Committee shall consist of up to 13 voting members
to be appointed by the Mayor with the advice and consent of the Council.
Members shall be appointed annually for a two-year term. Members of
the Committee shall serve without compensation. The Committee shall
designate one of its members to serve as Chairperson and presiding
officer of the Committee. The Committee is authorized to adopt bylaws
governing its procedural operations.
B. Powers and duties. The Community and Recreation Advisory Committee
shall advise the administration and Township Council concerning the
planning, implementation, and promotion of social service programs,
community building programs, and recreation programs and facilities.
It is understood that the Community and Recreation Advisory Committee
will act merely in an advisory capacity and shall not have the power
to bind the Township in any manner.
C. Director of Community Programs. The Mayor, with the advice and consent
of the Council, may appoint a Director of Community Programs to administer
social service and community building programs.
