The Mayor with the approval of a majority of the members of
the Board of Aldermen shall appoint a Chief of Police who shall perform
all duties required of the Marshal by law and any other Police Officers
found by the Board of Aldermen to be necessary for the good government
of the City. The Chief of Police shall be twenty-one (21) years of
age or older.
The Police of the City may be appointed in such numbers, for
such times and in such manner as may be prescribed by ordinance. They
shall have power to serve and execute all warrants, subpoenas, writs
or other process and to make arrests in the same manner as the Marshal.
They may exercise such powers in areas leased or owned by the municipality
outside of the boundaries of such municipality. The Marshal and Policemen
shall be conservators of the peace and shall be active and vigilant
in the preservation of good order within the City.

A.
Pursuant to Section 200.020, the Police of the City may be appointed in such numbers for such times and in such manner as may be prescribed by ordinance.
B.
The Chief of Police shall be appointed pursuant to Section 200.010 at the first regular meeting of the Board of Aldermen following the Mayoral election to serve a two-year term unless sooner terminated, voluntarily or involuntarily, by the Board of Aldermen.
C.
All Police Officers, whether full time, part time, temporary or Reserve,
shall be approved for employment by a majority vote of the Board of
Aldermen after recommendation for such employment by the Chief of
Police. All such positions are at will pursuant to Missouri employment
law.
D.
Involuntary termination of employment of any Police Officer shall
be by majority vote of the Board of Aldermen. The Chief shall have
the authority, however, to suspend employment of a Police Officer,
without pay, until a meeting of the Board of Aldermen can be held
to consider the issue.

A.
Any
Police Officer of the City of Sparta shall have the authority to respond
to an emergency situation outside the City boundaries when the emergency
situation arises within the County of Christian.
B.
Any
Police Officer of the City of Sparta shall have the authority to respond
to an emergency situation outside the City boundaries when an emergency
situation arises with any political subdivision that also has authorized
its Police Officers to respond to emergency situations arising within
the County of Christian.
C.
Deputies
of the Christian County Sheriff's Department, Christian County, Missouri,
are hereby authorized to respond to any emergency situation arising
in the City of Sparta, Missouri, after receiving a request for assistance
from the Sparta Police Department or one (1) of its Law Enforcement
Officers.
D.
Police
Officers of any political subdivision that has authorized its Police
Officers to respond within the County of Christian are also hereby
authorized to respond to any emergency situation arising in the City
of Sparta, Missouri, after receiving a request for assistance from
the Sparta Police Department or one (1) of its Law Enforcement Officers.
E.
As
used in this Section, "Police Officer" means an officer
who has completed the basic Police training program promulgated by
Chapter 590, RSMo., or has a waiver of same. As used in this Section, "respond" shall mean to take any and all actions which the
Police Officer may lawfully take as if exercising his/her powers within
the jurisdiction of his/her employing City or County. As used in this
Section, "emergency situation" means any situation
in which an officer has reasonable belief that a crime is about to
be committed, is being committed or has been committed involving injury
or threat of injury to any person, property or governmental interest
and that his/her response is reasonably necessary to prevent or end
such emergency situation or mitigate the likelihood of injury involved
in such emergency situation.

A.
It is unlawful within the City limits of Sparta, Missouri, for someone
who is not a Law Enforcement Officer to impersonate a Law Enforcement
Officer by:
1.
Wearing clothing, a badge or equipment that creates the appearance
that the person is a Law Enforcement Officer;
2.
Owning, possessing or operating a motor vehicle with striping,
insignia, decals, lights or equipment that replicate in whole or in
part the striping, insignia, decals, lights or equipment of a vehicle
used by a Sheriff's Department or Police Department within the
State of Missouri; or
3.
Representing verbally or in writing that the person is a Law
Enforcement Officer.
B.
Any person found guilty of violating this Section shall be deemed
to have committed an ordinance violation and shall be fined in an
amount not to exceed five hundred dollars ($500.00) plus costs; each
day of non-compliance is a separate violation.
C.
A motor vehicle within the City limits of Sparta, Missouri, with
striping, insignia, decals, lights or equipment that replicates in
whole or in part the striping, insignia, decals, lights or equipment
of a vehicle used by a Sheriff's Department or Police Department
within the State of Missouri may be impounded by the Sparta Police
Department; and, in the event of such impoundment, the Sparta Police
are hereby authorized to remove the offending striping, insignia and
decals.
