There shall be a Local Film Commission consisting of the Director of Public Safety, Director of Recreation and Business Administrator. The Commission shall be charged with the responsibility of overseeing the application of all rules, regulations and guidelines as set forth herein to those desiring to engage in filming by way of use of the Township streets, parks and other public places.

Anyone desiring to film or videotape in the Township in a way as set forth in § 299-1 shall first file an application for same in the Township Clerk's office. The Clerk's office will ultimately issue the permit. The permit must be required at least seven days prior to the requested shooting date with only the Local Film Commission having jurisdiction to waive such a requirement.
Proof of insurance must be provided in the following amounts:
A. 
For bodily injury: $250,000.
B. 
For property damage: $150,000.
The person or company responsible for filming must, without exception, give written notice to the residents and businesses directly affected by the filming at least five days before the requested shooting and include notice of any parking restrictions resulting from the filming to take place.
No filming shall be permitted in a restricted area after 10:00 p.m. and in any other area no later than 12:00 midnight.
A. 
The Township of Irvington can require that at least one or more on-site patrolmen be present at the scene of the filming for purposes of traffic and crowd control. The cost of deploying a patrolman for such reason shall be the responsibility of the permit holder.
B. 
The Township of Irvington may require an on-site electrician (in the event power lines are utilized or affected) with the cost of such person's presence being assessed to the permit holder.
C. 
The permit holder shall make the filming site accessible at all reasonable times for inspection by the Township Fire Prevention Bureau or other Township inspectors.
A. 
The Local Film Commission has the absolute right to reject any application for filming or videotaping if it finds any of the following:
(1) 
Interference with traffic flow.
(2) 
Unreasonable interference with property owners' use and enjoyment of their property.
(3) 
Any reason that it deems such filming or videotaping not to be in the best interests of the health, safety and welfare of the residents of the Township and/or surrounding area of the filming or videotaping.
B. 
Any person (resident or business) objecting to the filming shall file such objection with the office of the Township Clerk, with such objection becoming a part of the potential filmmaker's application. Such objection should be in writing.
Any person aggrieved by the Commission's decision to deny or revoke a permit can request relief from such decision by filing a written appeal before the Irvington Municipal Council. The Council shall act as an appellate review panel and decide to either affirm or reverse such decision.
A. 
The fee for a permit to film or videotape shall be $300. The permit, once issued, shall be issued for a period not to exceed 14 days. Renewal for an extended period of filming shall be at a cost of an additional $100 per week.
B. 
A fee of $5 per day shall be charged for each commercial vehicle used, with the total for such not exceeding $200 in total.
Any permit holder who shall violate any provision of this chapter shall be subject the penalty set forth in Chapter 1, Article III, Penalties, of the Township Code.
