The provisions of N.J.S.A. 40:49-5.1 et seq. and the International Existing Building Code 2015 are hereby accepted, adopted, and established as standards to be used as a guide in determining the fitness of a building for human habitation, occupancy, or use. Copies are on file in the office of the Borough Clerk and are available to persons desiring to use and examine the same.

Said code, established and adopted by this article, is described and commonly known as the "International Existing Building Code 2015," published by the International Code Council, Inc.

Three copies of the International Existing Building Code have been placed on file in the office of the Borough Clerk, upon introduction of this article, and will remain on file there until final action is taken on this article for the use and examination of the public.

The International Existing Building Code adopted under § 347-1 and named under § 347-2 is amended to add:
SECTION 112 RIGHT TO APPEAL
112.1 Petition. Any person affected by any notice which has been issued in connection with the enforcement of any provision of this code, or of any rule or regulation adopted pursuant thereto, shall have the right and be granted a review of the matter by the Appeals Officer, provided that such person shall file, in the office of the Appeals Officer, a written petition requesting such a review and containing a statement of the grounds therefor within 20 days after the day the notice was served.
112.2 Appeals Officer. In order to permit a review of a notice of violation prior to an appearance in the Municipal Court of the Borough of Penns Grove, an Appeals Officer is hereby established, which officer shall be the Construction Code Official or person acting in that capacity in the Borough in the absence of a Construction Code Official.
112.3 Review. The Appeals Officer shall hear all appeals made relative to the enforcement of this code and shall reverse or affirm, wholly or partly, or modify the decision appealed from and shall make such order or determination as in his opinion ought to be made.
112.4 Appeals process. The Appeals Officer is encouraged to personally review each property that is the subject of an appeal. If possible, the Appeals Officer should meet jointly with the property owner and the Housing Officer or Deputy Housing Officer who filed the notice of violation.
112.5 Written record. The Appeals Officer shall keep a written report concerning his investigation and findings in regard to each appeal filed.
112.6 Municipal Court. In the event that the decision appealed from is wholly or partially affirmed, the matter or matters shall be listed to be heard in the Municipal Court of the Borough of Penns Grove.

The Housing Officer and Housing Inspector of the Borough of Penns Grove shall have the right to make inspections, issue orders and otherwise enforce the provisions of the International Existing Building Code; provided, however, that all such activities of the Housing Officer and Housing Inspector with regard to the enforcement of the International Existing Building Code must be authorized by the Construction Code Official of the Borough of Penns Grove, who, notwithstanding the provisions of this section, shall remain primarily responsible for such enforcement.

In addition to the overall enforcement of the International Existing Building Code by the Construction Code Official, any police officer of the Borough of Penns Grove authorized by the Chief of Police is hereby empowered to make inspections, issue notices of violations, prepare and serve complaints and otherwise enforce the sections of the International Existing Building Code previously adopted which relate to exterior maintenance.
