A. Appointment. There is hereby created the position of Zoning Officer,
who shall be appointed by the Mayor and approved by Borough Council.
B. Duties. It shall be the duty of the Zoning Officer to see to the
enforcement of all ordinance provisions relating to zoning to ensure
compliance with the Borough ordinances.
C. Stop order. The Zoning Officer shall have the power to order all
work stopped on construction, alteration, repair or use of buildings
and property in the Borough when such work or use is in violation
of any provision of the zoning ordinances. Such work or use shall
not be resumed after the issuance of such an order, except on the
written permission of the Zoning Officer, provided that if the stop
order is an oral one, it shall be followed by a written stop order
within an hour. Such written stop order may be served by a police
officer of the Borough of Penns Grove.
D. Entry powers. The Zoning Officer shall have the power to make or
cause to be made an entry into any building or premises for the purpose
of making reasonable inspections for probable cause at any reasonable
hour.
E. Exceptions. Permits for uses which are a special exception or variance
to requirements of this chapter shall be issued only upon order, or
as otherwise provided by law or this chapter, of the Planning Board.
Nothing herein contained shall require any change in plans or construction
of a lawful use, the construction of which is started before the effective
date of this chapter and which is completed within one year of the
effective date of this chapter.

A permit shall be required prior to the erection or structural
alteration of any building, structure or portion thereof and prior
to the use or change in use of a building or land and prior to the
change or extension of a nonconforming use. Applications for permits
shall be made in writing to the Zoning Officer on such forms as may
be furnished by the Borough. Such application shall contain all information
necessary for the Zoning Officer to ascertain whether the proposed
erection, alteration, use or change in use complies with the provisions
of this chapter.

Permits shall be granted or refused within 10 days after the
written application has been filed with the Zoning Officer, except
where Planning Board site plan review is required.
A temporary permit may be authorized by the administrative officer pursuant to §
450-13.
Fees for permits shall be paid in accordance with a fee schedule
to be adopted by Council, and all such fees shall be paid into the
Borough treasury. Each applicant for an appeal, special exception
or variance shall, at the time of making application, pay a fee in
accordance with the aforementioned fee schedule.

For each and every violation of any provision of this chapter, the owner, contractor or other persons interested as general agent, architect, building contractor, owner, tenant or any other persons who commit, take part or assist in any violation of this chapter or who maintain any building or premises in which any violation of this chapter shall exist and who shall have refused to abate said violation after being ordered to do so, or who shall disregard a stop order or any other order issued by the Zoning Officer, shall be subject to any and all fines and penalties set forth in §
1-2 of the Code of the Borough of Penns Grove.
In addition to the remedy or remedies hereinbefore provided,
any person, persons, company or corporation violating this chapter
or any provision or section thereof may be proceeded against by the
Borough of Penns Grove or the appropriate official of the Borough
by appropriate action or by proceeding in equity or otherwise to prevent
and enjoin any threatened violation of this chapter.
