For the purpose of this article, "prohibited animal" means any domestic farm animal, including, but not limited to, horses, cattle, pigs, sheep, llamas, alpacas, goats, or any other hoofed animal or miniatures of such animals; any live monkey, alligator, crocodile, caiman, raccoon, skunk, fox, bear, sea mammal, or poisonous snake; any member of the cat family other than the domestic cat; any dangerous animal; and any animal which, by virtue of its species, would require a standard of care and control greater than that required for customary or traditional household pets legally sold by licensed commercial pet shops in Maryland; except a service animal is not prohibited, provided that it does not constitute a threat to public health and safety. "Prohibited animals" does not include chickens as provided in Article IV of this chapter.
A. 
No person shall sell, exchange, exhibit, give away, donate, board, harbor, foster, keep or permit to be kept on their premises as a pet, or as a source of eggs, or keep with the intent to slaughter as food, a prohibited animal. Prohibited or dangerous animals are those animals defined in § 48-32 of this article.
B. 
The provision of this article shall not apply to the following situations:
(1) 
The keeping of such animals in zoos, licensed educational or medical institutions or any place, excluding pet shops, where such animals are kept as live specimens for the public to view, or for the purpose of instruction or study.
(2) 
The keeping of such animals for exhibition by a circus, carnival, fair or any other commercial or nonprofit variety show featuring animal acts for entertainment.
(3) 
The keeping of such animals in a licensed veterinary hospital or animal shelter.
(4) 
The keeping of falcons, hawks or other raptors pursuant to a permit issued by an authorized federal or state agency.
In addition to any other enforcement action which the Town may take, violation of any provision of this article shall be civil violation, and a fine not exceeding $100 may be imposed. Each day that a violation continues will be treated as a separate offense.
