A prison labor program, which utilizes labor provided by prisoners from the Salem County Jail in accordance with the work release program utilized by the jail, is established.
Department heads of the Borough of Penns Grove may utilize the work services of prisoners who are participants in the work release program at the Salem County Jail to supplement, but not replace, the usual activities of employees of the Borough of Penns Grove in situations involving an extraordinary need. Prior to utilization of prison labor by any department head, as aforesaid, a detailed prison labor policy statement shall be prepared by the department head and presented to the committee of the Borough Council having oversight responsibility for the activities of the particular department. No prison labor may be utilized by any department head without prior written approval by Borough Council of a comprehensive prison labor policy statement. Said prison labor policy statement must include an insurance risk assessment and describe specifically aspects of the policy designed to address and, if possible, rectify any significant risk of injury or insurable loss.
No prison labor may be utilized by the Borough of Penns Grove, or any of its departments or employees, without there being a lawfully adopted, binding written agreement between the Borough of Penns Grove and the County of Salem describing the full nature of an agreement for the provision of prison labor by the Salem County Jail through the work release program. Any such prison labor agreement between the Borough of Penns Grove and the County of Salem must meet all applicable legal requirements and be properly executed by an officer or officers authorized by law to execute agreements on behalf of the respective entities.
