No person shall remove or cause to be removed, or deposit or cause to be deposited, soil or earth from any lot or parcel of land in the Township without having first obtained a permit from the Township Engineer for such purpose, as provided by this chapter; provided, however, that no permit shall be required for the removal of soil or earth in cases where less than one cubic yard is removed from the same lot in a period of one month or when the removal is for the purpose of creating a cellar under a building or sinking a tank.
A. 
Every application for a permit shall:
(1) 
Be made to the Township Engineer in writing.
(2) 
State the approximate number of cubic yards of soil or earth proposed to be removed.
(3) 
State the location from which the soil or earth is to be removed and the location to which it is to be moved.
(4) 
State the streets over which the soil or earth is to be hauled.
(5) 
Be accompanied by:
(a) 
A sketch of the lot from which removal is proposed to be made, which sketch shall show the depths to which it is proposed to make removal; and
(b) 
The permit fee, as provided by § 351-5.
B. 
In applications involving removal of soil or earth from an area in excess of 1,000 square feet, the Township Engineer may require an accurate topographical survey of the property, showing the existing grades and the grades which will result from the proposed removal.
No permit for the removal of soil or earth from any lot or parcel of land in the Township shall be issued if such removal of soil or earth will interfere with the proper surface drainage of said lot or adjoining lands or if such removal will result in a depression in which water may become stagnant or pest-breeding or if such removal will result in a condition detrimental or hazardous to the public health, safety or welfare.

It shall be unlawful for anyone to change the drainage pattern and grading to cause any drainage problems on the lot or surrounding properties. Any change in grading or drainage pattern shall require a permit from the Township Engineer.
The fee for a permit to remove soil or earth shall be $5.

Any person who violates any provision of this chapter shall, upon conviction thereof, be punished as provided in Chapter 1, Article I, of this Code. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
