For the purpose of supervising and maintaining West Grove Memorial Park, Harmony Park, and any other parks that may hereafter be acquired or established by the Borough of West Grove.
The following rules and regulations are hereby established for the management and protection of the Borough's park system hereinafter designated "the Borough's parks":
A. 
The Borough's parks shall be open to the public as follows:
(1) 
Tot lot: 8:00 a.m. until sunset.
(2) 
The Borough's parks: sunrise to sunset.
(3) 
Exception: any authorized activity or event scheduled by West Grove Borough Council.
B. 
Children under the age of 10 shall use the tot lot, with adult supervision.
C. 
No motor vehicle shall be operated on park property except in the designated parking area and, that required repairing and maintaining the Borough's Parks except as listed in § 292-3.
D. 
No alcoholic beverages shall be consumed and/or possessed on park property according to § 296-8 of Chapter 296, Peace and Good Order, Article I.
E. 
No person or persons shall dispose of any waste or garbage in the park except in receptacles designated for the respective purpose. All persons using the park shall dispose of all waste and garbage left by them in such property receptacles according to § 296-11 of Chapter 296, Peace and Good Order, Article I.
F. 
No person shall conduct himself or herself within the park as to annoy any other person using the park for recreational purposes and according to § 296-13 of Chapter 296, Peace and Good Order, Article I.
G. 
No person shall injure, deface, remove, cut or damage any of the trees, plants, shrubs, turf, buildings, structures or fixtures therein or any park property of the Borough located within the Borough's parks.
H. 
No person other than a law enforcement officer shall carry any firearm and/or weapons within the limits of the park, nor shall any person engage in hunting from within the park and or according to § 296-3 of Chapter 296, Peace and Good Order, Article I.
I. 
No person shall set or maintain a fire in the park except in stoves or fireplaces maintained for the purpose and located by the authority of the West Grove Borough Park and Recreation Board.
J. 
No person shall use or discharge fireworks, firecrackers, or other pyrotechnics within the park or according to § 296-4 of Chapter 296, Peace and Good Order, Article I.
K. 
No person shall remove any bench, seat, or table from the park or change the location thereof without permission from the Superintendent of Public Works.
L. 
No person shall injure, deface, or destroy any notice, rule or regulation posted any place within the park by authority of the West Grove Borough Council in accordance with § 296-12 of Chapter 296, Peace and Good Order, Article I.
Regulations for vehicles traveling or parking upon the roadways within the Memorial Park:
A. 
Parkway Avenue shall be a one-way roadway between the intersections of Rosehill Avenue and East Summit Avenue. The direction of travel shall be south on Parkway Avenue between these intersections.
B. 
The speed limit upon the entire length of Parkway Avenue shall be 15 miles per hour.
C. 
No parking shall be permitted on the east side of Parkway Avenue from Rosehill Avenue, south to the main parking lot.
D. 
The West Grove Borough Council may temporarily change these regulations for special events taking place within the Memorial Park.

Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Chester County.
