This article shall apply to the appointment, terms, functions
and powers of the appointment and employment of the Secretary to the
Planning Board.
As used in this article, the following terms shall have the
meanings indicated:
The Planning Board of the Town of Elma as established by
the Town Board pursuant to the provisions of § 271 of Town
Law.
The Secretary to the Planning Board.
A.Â
The Town
Board of the Town of Elma hereby enacts this article to provide a
process for appointing the Secretary to the Planning Board to assist
the Planning Board.
B.Â
The authority
of the Planning Board regarding the appointment and employment of
the Secretary to the Planning Board shall be transferred to the Town
Board.
C.Â
The Secretary
to the Planning Board shall be appointed by the Town Board to assist
the Planning Board.
This article is hereby adopted pursuant to the provisions of
§ 10 of the NYS Municipal Home Rule Law and § 10
of the NYS Statute of Local Governments. It is the intent of the Town
Board, pursuant to § 10 of the NYS Municipal Home Rule Law,
to supersede the provisions of § 271, Subdivision 2, of
the Town Law relating to the appointment or employment of the Secretary
to the Planning Board appointed or employed to assist the Planning
Board.
