[HISTORY: Adopted by the Township Council

No person in a public park and recreation area
shall:
A.
Wilfully mark, deface, disfigure, injure, tamper with
or displace or remove any buildings, bridges, tables, benches, fireplaces,
railings, pavings or paving materials, waterlines or other public
utilities or parts or appurtenances thereof, signs, notices or placards,
whether temporary or permanent, monuments, stakes, posts or other
boundary markers, or other structures or equipment, facilities or
park property or appurtenances whatsoever, either real or personal.
B.
Fail to cooperate in maintaining rest rooms and washrooms
in a neat and sanitary condition. No person above the age of five
years shall use the rest rooms and washrooms designated for the opposite
sex.
C.
Dig or remove any soil, rock, sand, stones, trees,
shrubs or plants or other wood or materials, or make any excavation
by tool, equipment, blasting or other means or agency.
D.
Construct or erect any building or structure of whatever
kind, whether permanent or temporary, or run or string any public
service utility into, upon or across such lands, except on special
written permit issued hereunder.
E.
Damage, cut, carve, transplant or remove any tree
or plant or injure the bark, or pick flowers or seed of any trees
or plant, dig in or otherwise disturb grass areas or in any other
way injure the natural beauty or usefulness of any area.
F.
Climb any tree or walk, stand or sit upon monuments,
vases, planters, fountains, railings, fences or upon any other property
not designated or customarily used for such purposes.
G.
Tie or hitch an animal to any tree or plant.
H.
Hunt, molest, harm, frighten, kill, trap, pursue,
chase, tease, shoot or throw missiles at any animal, wildlife, reptile
or bird, nor shall he remove or have in his possession the young of
any wild animal or the eggs or nest or young of any reptile or bird.
Exception to the foregoing is made in that snakes known to be deadly
poisonous or deadly reptiles may be killed on sight.
I.
Throw, discharge or otherwise place or cause to be
placed in the waters of any fountain, pond, lake, stream or other
body of water in or adjacent to any park or any tributary stream,
storm sewer, or drain flowing into such water, any substance, matter
or thing, liquid or solid, which will or may result in the pollution
of said waters.
J.
Have brought in or shall dump in, deposit or leave
any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish,
waste, garbage or refuse or other trash. No such refuse or trash shall
be placed in any waters in or contiguous to any park or left anywhere
on the grounds thereof but shall be placed in the proper receptacles,
where these are provided; where receptacles are not provided, all
such rubbish or waste shall be carried away from the park by the person
responsible for its presence and properly disposed of elsewhere.
K.
Drive any vehicle on any area except on the paved
park roads or parking areas or such areas as may on occasion be specifically
designated as temporary areas.
L.
Park a vehicle in other than an established or designated
parking area, and such shall be in accordance with posted directions
thereat and with the instruction of any attendant who may be present.
M.
Leave a vehicle standing or parked at night in established
parking areas or elsewhere in the park area.
N.
Leave a bicycle in a place other than a bicycle rack
when such is provided and there is space available.
O.
Ride a bicycle without reasonable regard to the safety
of others.
P.
Leave a bicycle lying on the ground or paving or set
against trees or in any place or position where other persons may
trip over or be injured by it.
Q.
Swim, bathe or wade in any waters or waterways in
or adjacent to any park, except in such waters and at such places
as are provided therefor and in compliance with such regulations as
are herein set forth or may be hereinafter adopted. Nor shall any
person frequent any waters or places customarily designated for the
purposes of swimming or bathing or congregate thereat when such activities
are prohibited by the Board of Recreation Commissioners upon a finding
that such use of the water would be dangerous or otherwise inadvisable.
R.
Frequent any waters or places designated for the purposes
of swimming or bathing or congregate thereat, except between such
hours of the days as shall be designated by the Board of Recreation
Commissioners for such purposes for each individual site.
S.
Erect, maintain, use or occupy on or in any beach
or bathing area any tent, shelter or structure of any kind unless
there shall be an unobstructed view into said tent, shelter or structure
from at least two sides, nor shall any guy wire, rope or extension
brace or support be connected or fastened from any structure to any
other structure, stake, rock or other object outside thereof.
T.
Allow himself to be so covered with a bathing suit
so as to indecently expose his person.
U.
Dress or undress on any beach or in any vehicle, toilet
or other place, except in such bathing houses or structures as may
be provided for that purpose.
V.
Bring into or operate any boat, raft or other watercraft,
whether motor-powered or not, upon any waters, except at places designated
for boating. Such activity shall be in accordance with applicable
regulations as are now or hereafter may be adopted.
W.
Navigate, direct or handle any boat in such a manner
as to unjustifiably or unnecessarily annoy or frighten or endanger
the occupant of any other boat.
X.
Launch, dock or operate any boat of any kind on any
water between the closing hour of the park at night and the opening
hour of the park the following morning, nor shall any person be on
or remain on or in any boat during said closed hours of the park.
Y.
Fish in any area where bathing is permitted.
Z.
Carry or possess firearms of any description, or air
rifles, spring guns, bow-and-arrows, slings or any other forms of
weapons potentially inimical to wildlife and dangerous to human safety,
or any instrument that can be loaded with and fire blank cartridges,
or any kind of trapping device. Shooting into park areas from beyond
park boundaries is forbidden.
AA.
Picnic or lunch in a place other than that designated
for that purpose.
BB.
Use any portion of the picnic area or any of the buildings
or structures therein for the purpose of holding picnics to the exclusion
of other persons, nor shall any person use such areas and facilities
for an unreasonable time if the facilities are crowded.
CC.
Leave a picnic area before the fire is completely
extinguished and before all trash is placed in the disposal receptacles,
where provided. If no such trash receptacles are available, then trash
shall be carried away from the park area by the picnicker to be properly
disposed of elsewhere.
DD.
Take part in or abet the playing of any games involving
thrown or otherwise propelled objects such as balls, stones, arrow,
javelins, horseshoes, quoits or model airplanes except in those areas
set apart for such forms of recreation.
EE.
Hire,
install or permit inflatable rides/games and pony rides.

FF.
Use the
facilities for profit, such as providing private lessons, charging
for use of the fields or pavilions, and any similar type use.

While in a public park or recreation area, all
persons shall conduct themselves in a proper and orderly manner, and
in particular, no person shall:
A.
Bring alcoholic beverages, drink same at any time,
nor shall any person be under the influence of intoxicating liquor
in a park.
B.
Have in his possession or set or otherwise cause to
explode or discharge or burn any firecrackers, torpedo rockets or
other fireworks, firecrackers or explosives of inflammable material,
or discharge them or throw them into any such areas from lands or
highways adjacent thereto. This prohibition includes any substance,
compound, mixture or article that in conjunction with any other substance
or compound would be dangerous from any of the foregoing standpoints.
At the discretion of the Board of Recreation Commissioners, permits
may be given for conducting properly supervised fireworks in designated
park areas.
C.
Appear at any place in other than proper clothing.
D.
Solicit alms or contributions for any purpose, whether
public or private.
E.
Build or attempt to build a fire except in such areas
and under such regulations as may be designated. No person shall drop,
throw or otherwise scatter lighted matches, burning cigarettes or
cigars, tobacco paper or other inflammable material within any park
or on any highways, roads or streets abutting or contiguous thereto.
F.
Enter an area posted as "Closed to the Public" or
"No Trespassing," nor shall any person use or abet in the use of any
area in violation of posted notices.

G.
Gamble or participate in or abet any game of chance
except in such areas and under such regulations as may be designated
by the Board of Recreation Commissioners.
H.
[1]Sleep or protractedly lounge on the seats or benches or
other areas or engage in loud, boisterous, threatening, abusive, insulting
or indecent language or engage in any disorderly conduct or behavior
tending to breach the public peace.

I.
Disturb or interfere unreasonably with any person
or party occupying any area or participating in any activity under
the authority of a permit.
J.
Paste, glue, tack or otherwise post any sign, placard advertisement or inscription
whatever, nor shall any person erect or cause to be erected any sign
whatever on any public lands or highways or roads adjacent to a park.
K.
Sell, offer or solicit for sale any goods or merchandise
in the park, unless affiliated with the Board of Recreation Commissioners.

A.
Township-owned property utilized for parks or recreation
and attendant areas, including but not limited to parking lots, shall
be open from sunrise to sunset. Activities conducted under the auspices
of Township-organized programs or areas specifically designated by
Township Council may exceed these hours.
B.
Any section or part of any park may be declared closed
to the public at any time and for any interval of time, either temporary
or at regular and stated intervals (daily or otherwise), and either
entirely or merely for certain uses.

A.
The Board of Recreation Commissioners and park attendants shall,
in connection with their duties imposed by law, diligently enforce
the provisions of this chapter.
B.
The Board of Recreation Commissioners and park attendant shall have
the authority to eject from the park area any person or persons acting
in violation of this chapter.
C.
The Board of Recreation Commissioners and park attendant shall have
the authority to seize and confiscate any property, thing or device
in the park or used in violation of this chapter.
D.
This chapter shall also be enforced by the Police Department of the
Township of Burlington.

Any person violating any of the provisions of this chapter,
or any rule or regulation promulgated pursuant hereto, and any person
using the field without obtaining a permit shall, upon conviction,
be subject to the replacement, repair or restoration of any damaged
park property and shall be subject to a fine not exceeding $2,000,
imprisonment for a term not exceeding 90 days or a period of community
service not exceeding 90 days, or any combination thereof.

A.
Reservations for Green Acres and Burlington Township athletic field
rentals may be made no earlier than seven calendar days in advance
of the requested date for the use of the field. Only one date per
application will be honored, and multiple dates will not be permitted.
No more than a maximum of four dates per year will be issued to any
specific group, league, association, etc. (Fees for the use of these
facilities will be charged to individuals or teams that have no affiliation
with the Burlington Township Recreation Commission or the Burlington
Township School District.)
B.
Resident/resident family shall consist of a person or family occupying or maintaining a place of residence within the Township. (See § 366-10, Definitions.)
C.
All fees collected for use of the Green Acres Park and Recreational
Facilities and Burlington Township Park and Recreational Facilities
shall be remitted to the Treasurer.

A.
Pavilion/band shell rental. A nonrefundable fee of $100 for residents
and $200 for nonresidents shall be charged for reserving a pavilion
for use by no more than 100 persons, which capacity limit may be reduced
by the Director of Recreation in the event of an emergency. The fee
must be paid at the time of registration.

E.
Street hockey court rental.
(1)
Court rental without lighting: $100, residents (not to exceed two
hours).
(2)
Court rental without lighting: $200, nonresidents (not to exceed
two hours).
(3)
Court rental with lighting: $150, residents (not to exceed two hours).
(4)
Court rental with lighting: $250, nonresidents (not to exceed two
hours).

B.
Proof of insurance. Upon application being made, a certificate naming
Burlington Township as an additional co-insured in the amount of $1,000,000
should be presented.
C.
Application of policy and procedures. The general policy, procedures
and insurance requirements outlined above shall apply to any group,
league, association, etc.

A.
Sylvan Lake facilities registration.
(1)
Resident/resident family shall consist of a person or family occupying or maintaining a place of residence within the Township. (See § 366-10, Definitions.)
(2)
Resident family fee: $50.
(3)
Nonresident family fee: $100.
(4)
Daily fee 17 and under: $5.
(5)
Daily fee 18 and over: $7.
(6)
Daily fee, senior citizens 62 and over: N/C.
(7)
Season pass, senior citizens 62 and over: N/C.
(8)
Lake replacement badge: $5.
B.
Sylvan Lake Complex meeting room. Nonprofit and civic organizations
desiring to use the Sylvan Lake Complex meeting room shall make application
on a reservation form which can be obtained from the Office of the
Director of Recreation. The reservation forms shall be completed and
submitted to the Recreation Department for review and approval. Organizations
seeking the use of the Sylvan Lake Complex meeting room shall be subject
to the policy and procedure regulations that will be provided with
the reservation form and which are attached hereto as Schedule A and
incorporated as part of the ordinance.[1] Future use of the meeting room by the organization will
be determined based upon its adherence to the policies and procedures
as set forth in the regulations. Failure to comply with those policies
and procedures could preclude the organization from the opportunity
of reserving the meeting room in the future.

A.
Any person boating, fishing and/or ice skating on or in municipally
owned waters shall do so at their own risk.
B.
Swimming in Township-owned lakes and all other Township-owned bodies
of water is restricted to that area known as the "Sylvan Lake Swimming
Beach" during its authorized hours of operation when lifeguards are
present.

A.
A fee of $30 shall be charged for each resident participant per program,
per season, which shall be paid upon registration for that program.
No registration will be accepted or processed without payment in full;
except for sports in which team membership is limited and determined
by skill level registration, fees shall be paid upon a child being
determined to have a satisfactory skill level to play for the team.
B.
A fee of $60 shall be charged for each nonresident participant per
program, per season, which shall be paid upon registration for that
program. No registration will be accepted or processed without payment
in full; except for sports in which team membership is limited and
determined by skill level registration, fees shall be paid upon a
child being determined to have a satisfactory skill level to play
for the team. Nonresident participant registration shall be accepted
only in the event there are an insufficient number of resident participants
to field a team.
C.
An additional fee of $30 shall be charged for participants of football,
youth baseball, softball, nontravel basketball, and Babe Ruth Baseball.

D.
An additional fee of $60 shall be charged for participants of Senior
Babe Ruth Baseball and travel basketball.

E.
No fees shall be charged for participation in a youth sports clinic.
A youth sports clinic shall be defined as a noncompetitive instructional
clinic. The intent and purpose of such a clinic is for educational
purposes and providing the participant with a basic understanding
of the sport which is the subject of that clinic, including, but not
limited to, basic skills, rules, and similar information.
F.
A late fee of $50 shall be assessed for any football participant
who does not return his/her equipment to the Recreation Department
by the date specified on the football registration form.[1]
