GENERAL REFERENCES
Streets and sidewalks — See Ch. 346.
As used in this chapter, the following terms shall have the
meanings indicated:
That portion of the Borough of West Grove consisting of the
following streets: West Evergreen Street, East Evergreen Street, Exchange
Place, Prospect Avenue, Walnut Street, Railroad Avenue, and the 100
block of Rosehill Avenue.
Skateboards, scooters, roller skates, and other human-powered
vehicles other than bicycles.
A.
No person shall operate a skateboard within 20 feet of a pedestrian.
B.
No person shall fail to maintain full control over a skateboard.
C.
No person shall ride a skateboard at an unsafe speed or in a reckless
manner (that is, with careless disregard for the safety of other persons
or property).
D.
No person shall operate a skateboard while holding on to another
vehicle (including but not limited to a bicycle or another skateboard).
E.
No skateboard ramp shall be constructed, used or maintained on any
street or sidewalk.
F.
No person shall operate a skateboard on streets in the downtown area.

G.
No person shall operate a skateboard between sunset and sunrise.
H.
At any other time when, due to insufficient light, or unfavorable
atmospheric conditions, persons are not clearly discernible from a
distance of 100 feet.
A.
A person engaged in skateboarding shall obey the instructions of
a police officer or other appropriately attired person authorized
to direct, control or regulate traffic.
B.
A person engaged in skateboarding shall obey traffic and pedestrian
control signals as provided under Pennsylvania Motor Vehicle Code,
Sections 3111 (relating to obedience to traffic control devices) and
Section 3113 (relating to pedestrian control signals).[1]

The person engaged in skateboarding shall yield the right-of-way
to any pedestrian and may not overtake or pass a pedestrian while
riding upon or propelling the skateboard. The operator of such skateboard
shall dismount from the skateboard and shall pass or overtake the
pedestrian on foot, or wait until the pedestrian passes, prior to
remounting the skateboard.
No person engaged in skateboarding shall suddenly leave a curb,
sidewalk, berm of street or any other place of safety and ride upon
or propel any skateboard into or toward the path of a vehicle which
is so close as to constitute a hazard. Where there are no pedalcycle
lanes, persons engaged in skateboarding upon a roadway shall ride
as near to the right of the roadway as practical, exercising due care
when passing a standing vehicle or one proceeding in the same direction.
No person shall place a ramp, half-pipe or other structure used
for skateboarding in a public thoroughfare, street, upon a sidewalk
or municipal parking lot within the Borough of West Grove.
Skateboards shall not be operated on private property without
permission from the owner or other person in charge of the premises.
A.
Enforcement. This chapter shall be enforceable by police officers
of the Borough of West Grove.
B.
Fine. The penalty for violation of this chapter shall be a $15 fine
to be enforced through the citation procedure in the same manner as
Vehicle Code violations.
C.
Impoundment option. At the police officers's option, an offender
may be offered an opportunity to avoid a fine or ticket by the offender
agreeing to the skateboard used in the offense being impounded by
the police officer. If the skateboard is impounded, it may be picked
up at the West Grove Police Station by the offender, and if the offender
is under age 18, by his parent or guardian, after reviewing this chapter,
and skateboard safety recommendations.
