A. 
The Zoning Law of the Village of Baldwinsville and the map entitled "Zoning Map, Village of Baldwinsville," dated May 1, 1989, are hereby amended by changing the following described area as set forth below from the existing Village and R-1 Residential to a planned development district to be known and described as "Fobes Island Planned Development District."
B. 
The area of the Fobes Island Planned Development District ("Fobes Island PDD") consists of 10.2 acres plus or minus in the Village of Baldwinsville and is bounded and described as set forth on the map entitled "Fobes Island Development," dated November 2015, on file with the Village Clerk, and is further described as follows:
Tax Map Parcels 009.-01-26.1, 009.-01-26.2, 009.-01-26.3, 009.01-27.0, 009.-01-28.0, 009.-01-29.0, 009.-01-30.1, 009.-01-30.2, 009.-01-32.0, 009.-01-33.0, 009.-01-34.0, 009.-01-35.0, 009.-01-36.0, 009.-01-37.0, 009.-01-38.0 (portion only), and 008.-01-12.0 (portion only)
A. 
There shall be constructed within the area of said Fobes Island Planned Development District two apartment buildings containing approximately 52 apartments, 22 apartment homes, eight townhomes and 10 single-family homes, as set forth on the site plan entitled "Fobes Island Development" dated November 2015, heretofore approved by and on file with the Planning Board of the Village of Baldwinsville (the "site plan").
B. 
No commercial uses shall be permitted in this planned development district.
C. 
Fobes Island Planned Development District shall be developed in the following manner:
(1) 
The project will be developed with an anticipated build-out schedule in phases. The construction of the apartment building will proceed as soon as financing can be obtained. The developer shall make application for financing as soon as practicable and commence construction as soon as practicable. The construction of apartment building A-1, as shown on the site plan, will be the first construction, to be completed in 2016, with apartment building A-2 to be completed in 2017, followed by the apartment homes and townhomes, to be completed in 2018. The build-out of the single-family homes will be the last construction phase and will begin subsequent to the construction of the apartment building and will be driven by market demand and absorption rate, and the entire construction on the site will be completed by the end of calendar year 2020.
(a) 
Before construction of Fobes Island Planned Development District is started or any building permit is issued relating thereto, final plans and specifications shall be submitted to and approved by the Planning Board of the Village of Baldwinsville and filed with the Village Clerk of the Village of Baldwinsville.
(b) 
During the construction of Fobes Island Planned Development District, there shall be constructed, as set forth as part of a site plan approved by the Planning Board of the Village of Baldwinsville, parking areas providing sufficient parking for all multiple dwelling units.
The developer shall obtain all necessary approvals and shall create a homeowners' association for the ownership and maintenance of certain of the common areas and the maintenance of the apartment homes and the townhomes. The common areas subject to the homeowners' association are as set forth on the site plan. The developer shall be responsible for maintenance and landscaping of all common areas until the homeowners' association assumes responsibility for those common areas of the apartment homes and townhomes. The homeowners' association shall be created prior to the issuance of any certificate of occupancy for any of the buildings to be constructed on the townhouse lots. The developer will be responsible for installation of all street trees as shown on the site plan.
A. 
All utilities will be located underground. The developer will construct the utilities and dedicate them to the Village of Baldwinsville with appropriate easements for maintenance to be dedicated to the Village.
B. 
There shall be a walkway titled "Asphalt Recreational Trail" along the Seneca River. A fifteen-foot easement as shown on the site plan will be dedicated to the Village of Baldwinsville and within that strip a six-foot asphalt trail will be installed by the developer. Prior to construction of the walkway, conduit to be supplied by the Village shall be installed by the developer for future lighting possibilities.
C. 
There shall be pedestrian walkways to the trail from Tabor Street and Margaret Street, which will be maintained by the developer.
D. 
There shall be 1.5 parking spaces set aside for each apartment in the apartment building structure.
E. 
The single-family homes will be constructed on separate lots which will be subdivided and shown as separate lots on the site plan and separately filed subdivision map. Sidewalks shall be constructed pursuant to the site plan as the first construction of a single-family home is completed.
This amendment shall be deemed automatically revoked and void, and the previous regulations and zoning designations shall obtain if, within four months from the approval by the Planning Board of the Village of Baldwinsville for construction of the project, commencement of the construction of the Fobes Island Planned Development District has not begun, or if, after construction has begun, unless substantial progress continues without undue interruption thereafter, or if the development is not completed within the time specified in § 345-116C(1). As to the area within which a building or buildings have been constructed pursuant to this article, there shall be no voiding of this amendment and as to said area and building or buildings, this amendment article shall continue in full force and effect and the area zoned by this article shall be the area within which said building or buildings was or were constructed pursuant to this amending article. For proper cause shown, the Village Board of the Village of Baldwinsville may, under such terms and conditions as it deems proper, extend either the four-month period or the final construction period, or both, and/or may waive the requirement that substantial progress shall continue without undue interruption.
