Pittsfield Charter Township designates the Municipal Services Department to be the municipal enforcing agency responsible for the administration and enforcement, within Pittsfield Charter Township, of Part 91, Soil Erosion and Sedimentation Control, of the Natural Resources and Environmental Protection Act, 1994 PA 451 (MCL 324.9101 et seq.), as amended (Part 91).
The Administrative Rules promulgated under the authority of Part 91 are hereby adopted and incorporated herein by reference.
Enforcement shall be conducted by qualified Township Ordinance Enforcement Officers designated by the Township Board of Trustees who hold a valid Soil Erosion and Sedimentation Control Certificate of Training from the Michigan Department of Environmental Quality. Such individuals shall have authority to issue municipal civil infraction citations for violations of this article.
Municipal civil infraction fines shall be deposited and retained pursuant to Chapter 2, Article V, Municipal Civil Infractions; Civil Fines and Penalties, of this Code, at the Pittsfield Charter Township Municipal Ordinance Violations Bureau, under the supervision and control of the Township Treasurer.
In addition to the landowner/permittee, those contractors, builders, and all other individuals undertaking an earth change shall be liable for any civil penalties imposed for violation of this article.
The Township may issue a stop-work order for all work on the site until the provisions of this article, including any conditions attached to a permit, have been fully met. Failure to obey a stop-work order shall constitute a separate violation of this article.
Permit fees shall be established and periodically revised by resolution of the Pittsfield Charter Township Board of Trustees. If an earth change has been started before the issuance of a permit, the permit fee shall be double the standard amount.
