The owner or owners and/or person or persons in possession (e.g., tenants) of real property on which a public sidewalk is located shall, within the first 12 hours of day light after snow, hail and/or ice has accumulated on the sidewalk, remove said snow, hail and/or ice from the sidewalk to the full length and width of the sidewalk on said property. For purposes of this regulation, when any parcel of land or lot fronts or abuts on a public sidewalk, such sidewalk shall be deemed to be on such parcel or lot, for the full length of such frontage.
Should snow, hail and/or ice not be removed from any sidewalk according to § 346-1 hereof, the Borough may remove same and the persons responsible for such removal, under § 346-1, shall pay the Borough's cost for such removal. If such persons do not pay said costs, the property may be liened and subjected to all the remedies for recovering municipal claims.
Any person who shall fail to comply with § 346-1 hereof shall be subject to a fine or penalty which shall not be less than $20 for the first violation, $50 for the second violation and $75 for the third and subsequent violations in any calendar year.
