A building that is protected by an automatic alarm system, fire
suppression and/or a standpipe system is difficult because of secured
openings; and where immediate access is necessary for life-saving
or fire-fighting purposes, a rapid access key box shall be installed
by the owner(s) of the property at a location approved by the Fire
Chief or his designee. The rapid access key box shall be of a type
and size approved by the Fire Chief or his designee.
The Fire Chief or his designee may require the owner(s) of the
property to install a rapid access key box tamper switch connected
to the building's fire alarm system, if necessary.
When a property is protected by a locked fence or gate and where
immediate access is necessary for life-saving or fire-fighting purposes,
the Fire Chief or his designee may require the owner(s) of the property
to install a security padlock. The padlock shall be of a type and
size approved by the Fire Chief or his designee.
When a building is protected by an automatic sprinkler or standpipe
system and the Fire Department connection is exposed to vandalism,
the Fire Chief or his designee may require the owner(s) of the property
to install a Fire Department connection security cap(s). The Fire
Department connection security cap(s) shall be of a type approved
by the Fire Chief or his designee.
The term "building" used herein means any building or structure
located in the Town of Middleborough, whether privately or publicly
owned, including, without limitation, any building owned by the Town
of Middleborough, the Town of Middleborough School Department, any
housing authority or any other public, quasi-public, or private entity
or person; provided, however, this bylaw shall not apply to owner-occupied
one- and two-family dwellings.
A.
The rapid response key boxes shall contain the following:
(1)
Keys to locked points of egress, whether in the interior or on the
exterior of such buildings;
(2)
Keys to the locked mechanical rooms;
(3)
Keys to the locked elevator rooms;
(4)
Keys to elevator controls;
(5)
Keys to any other area that may be required by the Fire Chief or
his designee;
(6)
A card containing the emergency contact people and phone numbers
for such building.

In addition, a floor plan of the rooms within the building may be
required.
All existing buildings shall comply with this bylaw within one
year from its effective date. All newly constructed buildings not
yet occupied or buildings currently under construction and all buildings
or businesses applying for a certificate of occupancy shall comply
within 30 days after the effective date of this bylaw.
Failure to comply with this bylaw shall be punished by a fine
of $100, or, in the case of a continuing offense after notice of such
violation, to a fine of not more than $100 for every day on which
the violation continues.
