1. 
This Part 7 supplements the provisions of the Zoning Ordinance by providing special provisions specifically designed for the mobile home park development. To the extent that the Zoning Ordinance or this Part 7 does not provide regulations on a subject, the general provisions of this Chapter 22 and the Zoning Ordinance apply.
2. 
The provisions of this Part 7 supersede any contrary provisions of this Chapter 22. Whenever possible, these provisions shall be compatible with the remaining provisions of this Chapter 22.

1. 
Access. Provisions shall be made for safe and efficient entrance and exit to and from public streets and highways serving the mobile home park development without causing interference with normal traffic.
2. 
Primary Streets. Streets connecting the mobile home park development with any public street or road shall meet the requirements for primary streets imposed by this Chapter 22.
3. 
Local Streets. Streets providing access to abutting mobile home lots shall meet the requirements for local streets as required by this Part 7.
4. 
Cul-de-Sac. Streets shall meet the requirements of this Chapter 22.
5. 
Street Construction Design Standards. All streets shall be constructed in accordance with the Township specifications applicable to public streets in conventional residential developments.

All utilities shall be installed underground. Utilities shall be installed and maintained in accordance with utility company specifications regulating such systems.

1. 
The design, installation, construction and maintenance of systems, including containers and pertinent equipment, for the storage and handling of liquefied petroleum gases shall conform to the Act of Pennsylvania Legislation 1951, December 27, P.L. 1793, as it may be amended, and to the regulations issued pursuant to that Act by the Pennsylvania Department of Labor and Industry.
2. 
Fuel oil tanks shall be installed underground.
3. 
All other fuel tanks shall be screened by fencing.
4. 
All fuel supply and storage shall meet the requirements of the Newtown Township ordinances currently in effect.

The storage, collection and disposal of refuse in a mobile home park shall be conducted so as to create no health hazards, rodent harborage, insect breeding areas, accident or fire hazards, or air pollution, and shall comply with the Bucks County Department of Health Regulations governing mobile home parks. Refuse storage areas shall be suitably screened by fencing.

Grounds, buildings and structures shall be maintained free of insect and rodent harborage and infestations. Plans for extermination and other measures to control insects and rodents shall be submitted with the Final Plan and shall conform to the requirements of the Bucks County Department of Health Regulations governing mobile home parks. The area between the ground level and the perimeter of the mobile home shall be enclosed by a rodent-proof skirting of wood, aluminum or other similar material.

Lighting facilities shall be provided and arranged so as to ensure the safety and convenience not only of mobile home park residents but to protect residents of neighboring properties and the users of adjacent highways from direct glare or interference and shall, except to the extent inconsistent herewith, be governed by the provisions of this Chapter 22 and the Zoning Ordinance currently in effect, both as amended.
2. 
Street Lights Shall be Installed:
A. 
At all street intersections. (Mandatory at all dead-ends.)
B. 
All other spots determined to be hazardous by the Township Supervisors on the advice of the Township Engineer.
C. 
With style, type, height and manufacturer subject to the approval of Township Supervisors on the advice of the Township Engineer.
D. 
So that maximum spacing of street lights shall be 200 feet.
3. 
The mobile home park operator and owner shall be responsible for all costs of lighting, including electricity.

All signs shall be subject to the general provisions of the Zoning Ordinance applicable in a residential district. One additional sign may be permitted to identify the mobile home park development to the general public. That sign shall be located no closer than 20 feet from the ultimate right-of-way line of any State or Township road which serves as a boundary line for the development. The sign shall not have more than 20 square feet of notice area on either side and shall not be illuminated by any harsh or glaring light which would reflect other than directly upon a notice surface of the sign.

All applicable provisions for review and approval under the procedures for a PRD in an R-2 High Density Residence District shall apply.

1. 
It shall be unlawful for any person to construct, alter, extend or operate any mobile home park in the Township unless he holds:
A. 
A valid Certificate of Registration issued by the Bucks County Department of Health in the name of such person for the specific construction, alteration, extension or operation proposed; and
B. 
A license issued by the Township pursuant to Subsection (5) of this § 711.
2. 
Application to Bucks County Department of Health. Applications for Certificates of Registration shall be made by the owner of the mobile home park in accordance with the "Bucks County Department of Health Rules and Regulations for Mobile Home Parks."
3. 
Application to Newtown Township. An application for a mobile home park license shall be filed with, and the license issued by, the Board of Supervisors. Applications shall be made by the owner, proprietor or operator of the mobile home park, in writing, signed by the applicant, and containing or accompanied by the following:
A. 
Name and address of the applicant.
B. 
Location and description of the mobile home park.
C. 
A complete plan of the mobile home park showing compliance with the full and complete terms of this Chapter 22 and the Bucks County Department of Health's Rules and Regulations concerning mobile home parks.
4. 
Inspection and Issuance of Licenses.
A. 
The application and all accompanying plans and specifications shall be filed in quadruplicate. The Board of Supervisors shall review and process the plans in accordance with the provisions set forth in the appropriate ordinances. If the application is approved, the Board of Supervisors shall issue the license, which shall be valid for one year.
B. 
In the event of variance between the requirements of the Township and the Bucks County Department of Health, the higher standards shall be applied.
5. 
Renewal Licenses. Renewal licenses for a period of one year may be issued by the Board of Supervisors on or before the expiration date of the existing license, after:
A. 
Inspection and approval by the Zoning Officer and Fire Official.
B. 
The applicant has furnished proof that the mobile home park continues to meet the standards prescribed by the Bucks County Department of Health and this Chapter 22.
6. 
Fees. Each application for a new or renewal license hereunder shall be accompanied by payment of a license and inspection fee, the amount of which is determined from time to time by the Board of Supervisors. If the Township Engineer and/or Zoning Officer are required to perform additional or unusual services reviewing said application, the cost of such additional services shall be borne by the applicant.
7. 
Transfer of Ownership of Mobile Home Park. Every person holding a license shall file a written notice with the Bucks County Department of Health and with the Township Zoning Officer within 10 days after having sold, transferred, or otherwise disposed of any interest in or control of any mobile home park. If the Certificate of Registration is transferred by the Bucks County Department of Health, proof of such transfer shall be promptly furnished to the Township Zoning Officer.

1. 
Inspectors. The Zoning Officer is designated as the representative of the Township to make such inspections. Other inspectors, who must also be designated as Zoning Officers, may be authorized to make inspections at the discretion of the Board of Supervisors.
2. 
Inspections. Upon notification to the licensee, manager, or person in charge of the mobile home park, a representative of the Township may inspect any mobile home park at any time to determine compliance with this Chapter 22.

1. 
The operator and owner of the mobile home park shall be responsible for maintaining and repairing all common facilities, including, but not limited to roads, parking areas, sidewalks or pathways, common open space, water supply and sewage disposal systems, and service buildings.
2. 
All roadways within a mobile home park shall be accessible to emergency vehicles at all times.

1. 
Notice of Violation and Compliance Order. Whenever the Board of Supervisors shall determine that there has been a violation of any provision of this Chapter 22, it shall give notice of such alleged violation to the person to whom the permit or certificate was issued. The notice shall be in writing, and shall:
A. 
Include a statement of the reasons for its issuance.
B. 
Allow a reasonable time for the performance of any act required.
C. 
Be served upon the person to whom the certificate was issued or his agent as required by the laws of the Commonwealth of Pennsylvania.
D. 
Contain an outline of remedial action which, if taken, complies with this Chapter 22.
2. 
The operator and licensee shall have 30 days after notice of violation to correct any violations, except if the inspector shall determine that the violation constitutes a hazard to the health or safety of the residents of the mobile home park, he shall order that the violation be corrected immediately.
3. 
Revocation. Upon failure of a permit holder to comply with the Notice of Violation and Compliance Order, the Board of Supervisors shall revoke the permit and shall issue an order terminating the operation of the mobile home park.
4. 
Appeal. The holder of a permit which has been revoked may appeal the revocation to a court of competent jurisdiction. The appeal shall be made within 30 days after the date of issuance of the revocation order.
5. 
Other Remedies. In addition to any other procedures provided for in this Chapter 22, the Board of Supervisor may institute, in the name of the Township, an appropriate action or proceeding to enforce the provisions of this Chapter 22 to prevent their violation.

All expenses incurred by the Township in connection with the review and processing of plans for any mobile home park, including engineering, planning, legal and administrative costs, shall be repaid to the Township by the developer before any occupancy permits for mobile homes shall be issued.
