As used in this article, the following terms shall have the meanings indicated:
WILD ANIMAL
That which is not of a species customarily used or kept as an ordinary household pet.
A. 
One which ordinarily would be confined to a zoo, or one which would ordinarily be found in the wilderness of this country;
B. 
Specifically, and not limited to, geese and ducks or other wild waterfowl at the public park known as Reservoir Park and the waterways known as the Little Juniata River and Bald Eagle Creek, all of which are found within the confines of the Borough; and
C. 
Includes any animals prohibited from being owned as domestic pets under the laws of the Commonwealth of Pennsylvania and the Code of the Borough of Tyrone.
No person shall feed food or any other type of edible substance to any wild animal on property owned, leased, maintained or managed by the Borough of Tyrone, specifically but not limited to, geese and ducks or other wild waterfowl at the public park known as Reservoir Park and the waterways known as Little Juniata River and Bald Eagle Creek. Leaving refuse on Borough property while awaiting routine pickup shall not constitute feeding wild animals. If, however, the same constitutes littering under the laws of the Commonwealth of Pennsylvania, anyone so leaving such refuse may be subject to fines as set forth in the laws of the Commonwealth of Pennsylvania and the Borough of Tyrone.
A. 
Any person violating any provisions of this article, in a summary proceeding before any Magisterial District Judge, upon conviction, shall be sentenced to pay a fine of not more than $300, plus costs of prosecution, and, in default of payment of such fines and costs, to be imprisoned for not more than 30 days. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
B. 
The provisions of this article shall be enforced by the Police Department of the Borough of Tyrone.
