The purpose of this district is to provide regulations for mobile
homes on individual lots and mobile home parks at a medium density.
In the case of mobile home parks, regulations are designed to assure
good site development, a more efficient use of land and to offer further
opportunity for affordable housing.

Land, buildings or premises shall be used by right only for
the following uses:

Land or buildings within 400 feet of the right-of-way of Township Line Road may be developed or used in accordance with the requirements of Article XV, Township Line Commercial District. Development or use of this limited area, utilizing the standards of Article XV, Township Line Commercial District, shall be subject to conditional use approval from the Upper Chichester Township Board of Commissioners and the provisions of Article XXII, Standards and Procedures for Conditional Uses.
D.
Recreation/community center building for the exclusive use of residents
and their guests.
E.
Refuse collection receptacles, provided they are screened from adjoining
properties and from public view by a visual screen.
G.
Any accessory uses or structures customarily incidental to the main
entrance, servicing and safety of mobile home park residents shall
be permitted only as part of an approved development plan for the
site.
Unless specifically stated otherwise, the following shall be
minimum requirements:

Mobile homes on individual lots.
C.
Mobile home parks.
(1)
Tract size: 10 acres.
(2)
Gross density: six units per acre.
(3)
Lot size: 3,500 square feet.
(4)
Lot width: 35 feet.
(5)
Street frontage: 25 feet.
(6)
Front yard: 20 feet.
(7)
Side yard: eight feet each.
(8)
Rear yard: 10 feet.
(9)
Building setback from exterior right-of-way: 50 feet.
(10)
Building height: one story, maximum, and 15 feet, maximum.
(11)
Building coverage: 30%, maximum.
A.
The tract of land to be developed must be under single ownership.
B.
Open space. Not less than 20% of the tract shall consist of common
open space; 75% of the common open space shall be outside the one-hundred-year
floodplain and outside of slopes of 15% or greater.
C.
Buffer area. There shall be a buffer area of not less than 25 feet
along the perimeter of the tract.
D.
Screening. Where applicable, there shall be a planted visual screen six feet high within the buffer area. See § 600-172.
E.
Fuel storage containers shall be securely placed and shall not be
less than five feet from any exterior window of a mobile home.
F.
All utilities shall be installed underground unless such placement
is deemed not feasible by the Board of Commissioners.
G.
All mobile homes in a mobile home park must be served by both municipal
water and public sewer.
H.
Fire hydrants shall be installed by the developer to meet the requirements
of the Township and the Township Fire Marshal.
A.
Permits required. It shall be unlawful for any person to construct,
alter, extend or operate a mobile home park within Upper Chichester
Township unless and until he obtains:
(1)
A building permit issued by the Township Building Inspector after
having paid a fee for each unit to be placed within the mobile home
park.
(2)
Annual licenses. In addition to the initial permits, the operator
of a mobile home park shall apply for an annual license to the Upper
Chichester Township Zoning Officer on or before the first day of December
of each year for an annual license. Upon satisfactory proof that the
park continues to meet the standards prescribed by the state, county
and Township regulations, the Zoning Officer having jurisdiction over
the standards of this chapter shall issue or deny the license.
B.
Fees.
(1)
Fees for the initial application and preliminary and final approvals
shall be prescribed by resolution of the Township Commissioners.
(2)
The fee for the annual license shall be prescribed by resolution
of the Township Commissioners and shall be submitted to the Zoning
Officer with the application for the annual license.
C.
Inspection.
(1)
The Township Zoning Officer or Building Inspector may inspect a mobile
home park at the reasonable intervals and at reasonable times to determine
compliance with this chapter.
(2)
Whenever, upon inspection of any mobile home park, it is determined
that conditions or practices exist which are in violation of any provision
of this chapter, or any regulations adopted pursuant thereto, the
Upper Chichester Township Secretary shall give notice in writing to
the person to whom the certificate was issued, advising him that unless
such conditions or practices are corrected within a reasonable period
of time specified in the notice, the license to operate in Upper Chichester
Township shall be suspended at the end of such period. Such mobile
home park shall be reinspected, and, if such conditions or practices
shall have not been corrected, the Township Secretary shall suspend
the license and give notice in writing of such suspension to the person
to whom the certificate is issued.
D.
Maintenance requirements.
(1)
The operator/license of the mobile home park shall be responsible
for the proper repair and maintenance of all common open space water
supply and sewage disposal system and community buildings.
(2)
Prior to issuance of any certificate of occupancy pursuant to final
approval of an application for a new development or expansion, the
operator or licensee of a mobile home park shall post with the Township
a maintenance bond in a form acceptable to the Township Solicitor
in an amount sufficient to cover for a period of two years the cost
of maintenance of common areas and facilities. Said cost shall be
estimated by the Township Engineer or other person designated by the
Commissioners.
