This Part shall be known, and may be cited, as the Borough's
"Wastewater Discharge Limitations Ordinance."

The Borough hereby adopts Ordinance No. 15346 of the City of Allentown, enacted by City Council on February 1, 2017, and signed by the Mayor on February 9, 2017, as its Wastewater Discharge Limitations Ordinance, subject to the revisions, additions and exceptions as more particularly set forth in § 18-303, herein.

The following constitute the revisions, additions and exceptions
to the adoption of Ordinance 15346 as the Borough's Wastewater Discharge
Limitations Ordinance:
1.
Nothing contained in, or required by, Ordinance 15346 shall be interpreted
or applied to supersede, contravene or modify any of the rights, duties,
obligations, requirements or terms of any intermunicipal agreements
between the Borough and the City of Allentown, including, without
limitation, the agreement of March 17, 1959, and in all respects,
such intermunicipal agreements shall remain and continue in full force
and effect, except as may be amended by the parties in writing from
time to time.

Nothing contained in, or required by, Ordinance 15346 shall be interpreted
or applied to cause the Borough to be a "user" or an "industrial user"
as those terms are defined or used in Ordinance 15346, with respect
to the Borough's operation or maintenance of the Borough-owned POTW.
3.
Section 2.1.B.12 of Ordinance 15346 is deleted, but only to the extent
that it conflicts with the agreement between the Borough and the City
of Allentown, dated March 17, 1959.
4.
Section 2.5 of Ordinance 15346 is deleted, but only to the extent
that it conflicts with the agreement between the Borough and the City
of Allentown, dated March 17, 1959.

All reporting requirements applicable to users or industrial users
which are set forth in Ordinance 15346 shall be deemed amended to
include the requirement that all reports required to be submitted,
in addition to being submitted to the City of Allentown or the Lehigh
County Authority, as the case may be, shall be submitted also to the
Borough Manager of the Borough of Emmaus.
6.
Nothing contained in, or required by, Ordinance 15346 shall be interpreted
or applied to limit the right of the Borough to, subject to Borough
discretion, enforce the requirements of Ordinance 15346 with respect
to users and industrial users located within the Borough.
