An Emmaus Arts Commission consisting of up to 13 members shall
be created and its membership shall be appointed by the Emmaus Borough
Council. Said members are encouraged to be representatives of business,
education, artistic, governmental and civic communities of the Borough
of Emmaus. Membership shall be no less than nine Borough residents
and no more than four non-Borough residents. For the purposes of this
section, a resident shall include anyone living within the Borough
of Emmaus, as well as any business owner with a physical business
address in the Borough of Emmaus. Appointed members shall perform
all duties and may exercise all powers conferred in accordance with
the laws of the Commonwealth of Pennsylvania.

The Emmaus Arts Commission shall promote and encourage public
artistic programs; further the development and public awareness of
an interest in the fine and performing arts; provide for the assessment
of the artistic needs of the community; provide the means of development
of a comprehensive Borough wide plan to encourage and strengthen artistic
and cultural resources; develop programs in the arts which shall seek
to introduce the visual and performing arts to Borough residents who
have previously not participated in such activities and encourage
existing organizations to develop new ways to reaching the community;
provide a form of communications between representatives of the community
and the Borough; act as an advisory board to the Borough on all matters
pertaining to the arts and the cultural development of the Borough.

Said members shall be representatives of business, education,
artistic, governmental and civic communities of the Borough of Emmaus
and shall include at least one member of Borough Council.

The initial terms of the first 11 members shall be for a period
of three years. Members of the Emmaus Arts Commission, appointed by
Borough Council subsequent to the date of adoption of this amendment,
shall be appointed to a term of three years.

The Emmaus Borough Council may remove any and all members of
the Arts Commission for official misconduct including, but not limited
to, neglect of duty and may fill the vacancy for any expired term
of any previously appointed member of the Commission.

Subject to the approval of the Emmaus Borough Council, the Emmaus
Arts Commission may enact its own rules and regulations in furtherance
of carrying out its duties.

The Emmaus Arts Commission shall annually report in writing
to Council. The report shall contain a statement detailing all activities
conducted during the year. In addition each annual report shall contain
an income/expense statement.
