Whereas the Borough of Emmaus has heretofore established a Police Department and has also designated one of the members thereof as Chief of Police and has designated other members thereof to serve as Lieutenant, Sergeant and Criminal Investigator, and has also appointed part-time auxiliary police, park police and crossing guards and part-time police; the Borough of Emmaus desires to continue said department and the positions therein, and to expand said positions and activities.

The existing Police Department is here recognized and his hereby reestablished in and for the Borough of Emmaus.

The Borough Council shall appoint one member of the Police Department to serve as Chief of Police, said appointment to be made as provided under the Borough Code (Act of February 1, 1966, P.L. 1656, Act No. 581, as amended). The Chief of Police shall be the Chief Executive of the Police Department. He shall, under the direction of the Mayor, be in charge of the police force and have supervision of its members in the exercise of their powers, duties and authority. Such powers, duties and authority are as specified in Act of February 1, 1966, P.L. 1956, Act 581, 53 P.S. § 46121.

Subordinate to the Chief of Police, in the Police Department, the following classifications are hereby established: Deputy Chief of Police, Captain, Lieutenant, Sergeant, Detective, Corporal and full-time police officer, and part-time auxiliary police officer, or those of such classification to which Council shall at any specific time have appointed one or more police officers. The priority of authority among such subordinate classifications shall be in the order listed above. The number of persons to serve in each of such subordinate classifications on a full-time and/or part-time basis shall be as determined by the Borough Council from time to time.

Full-time members to the Police Department shall be appointed by Borough Council in accordance with the manner as set forth in Act of February 1, 1966, P.L. (1965), 53 P.S. § 46184.

All members of the Police Department of the Borough of Emmaus, all classifications of part-time police, auxiliary police, and special school police shall, before they enter upon their duties, be sworn in by the Mayor.

The compensation of the Chief of Police shall be as determined by the Borough Council from time to time with full recognition of the Police Chief Act. The compensation of other full-time members of the Police Department of the classifications listed above shall be as determined by Borough Council, from time to time, subject to collective bargaining procedures as stipulated by law (Act III of 1968). The compensation of part-time police, including all categories of part-time police (i.e., part-time auxiliary assigned to regular police duties, part-time auxiliary assigned to park duties, etc.) shall be as determined by Borough Council by resolution.

The Borough Council hereby confirms its establishment of the position of part-time police officers. Such appointments may be made in accordance with the Act of February 1, 1966, P.L. (1965) 1121, 53 P.S. § 46121.

Part-time members of the Police Department may be appointed by Borough Council in accordance with and in full recognition of such rights as may be conferred upon soldiers in accordance with the Veterans's Preference Act as interpreted by prevailing case law. A prior condition precedent and qualification for appointment to the position of part-time police officer assigned to regular police duties shall be successful completion of a period of six months of service as a part-time auxiliary police officer assigned to regular police duties in the Borough of Emmaus.

Part-time police, while on active duty, shall have the same powers of arrest and law enforcement as the full-time police officers of the Borough of Emmaus.

Part-time police, when on active duty, shall have the same duties as the full-time police officers of the Borough of Emmaus and shall act in accordance with the policies and procedures in effect at the time.

The Borough Council hereby declares its intent to create and hereby creates an auxiliary police force to supplement the regular police force in times of need.

The Chief of Police shall nominate persons as auxiliary police who have satisfactorily completed such training as the Chief may prescribe and/or may be prescribed by law. All such persons so nominated shall, before they enter upon their duties, be approved by the Mayor and a majority of Borough Council, and be sworn by the Mayor.

Auxiliary police shall serve until terminated by the Borough Council. The Chief of Police may recommend termination of any auxiliary officer for cause.

Auxiliary police, when on active duty, shall have the same powers as the regular police officers of the Borough of Emmaus, and shall perform such other duties as may be assigned to them by the Chief of Police. Auxiliary police officers, when on active duty, are hereby designated as peace officers of the Borough of Emmaus. The powers herein conferred may be exercised by auxiliary police officers only after they report for active duty and until they are relieved from duty.

The Chief of Police, under the direction of the Mayor, shall have charge of all auxiliary police and shall have supervision of auxiliary police in the exercise of their duties, powers and authorities. Auxiliary police shall perform such duties as may be assigned to them by the Chief of Police. These duties include, but are not limited to, aiding and supplementing the regular police force in routine duties, providing police protection at athletic events, serving as park police officers or guards, acting as crossing guards and such other assignments as the Chief of Police may determine.

The compensation for persons serving as auxiliary police shall be as determined by Borough Council, from time to time.

The Borough Council may appoint special school police.

Special school police shall have the duty of controlling and directing traffic at or near schools and shall be in suitable and distinctive uniforms and shall display a badge or other sign of authority, and while on duty, shall be under and subject to the direction of the Mayor. Such appointments shall be in accordance with Act of February 1, 1966, P.L. (1965), 53 P.S. § 46127.

Special school police shall serve at the pleasure of the Borough Council and shall not come within the civil service provision of the Borough Code and shall not be entitled to participate in any police pension plan and plans now in effect or hereafter effective.

The compensation for persons serving as special school police shall be fixed by the Borough Council and shall be jointly paid by the Borough Council and Board of School Directors.
