A. 
The Police Department shall consist of a Chief of Police and such other officers and number of patrol officers designated by the Village Board.
B. 
The Chief of Police shall be appointed by a two-thirds vote of the members of the Mishicot Village Board. The Chief of Police shall, in addition, obey all lawful written orders of the Village Board or the Village President respecting the maintenance of peace and good order of the Village of Mishicot.
C. 
Patrol officers, if duly appointed by a vote of 2/3 of the members of the Village Board and fully qualified under local and state laws, shall serve under the direction of the Chief of Police as head of the Police Department. Officers shall serve a probationary period of one year, unless otherwise approved for a different period by the Village Board. During the probationary period, the Village Board may, at its option, lay off or terminate, with or without cause, said probationary employee without recourse to any grievance and arbitration provisions then in effect.
The Chief of Police and patrol officers, if duly appointed and qualified, may use the automobiles and weapons and safety gear and other items now owned by the Village or hereafter acquired for future use. The procurement of equipment and supplies required by the Chief of Police in the operation of the Police Department, including automobiles for the police work, weapons, etc., shall be prescribed from time to time by the Village Board.
Every member of the Police Department shall:
A. 
Familiarize him/herself with the ordinances of the Village and the state statutes and attend to the enforcement of such ordinances by all lawful means.
B. 
Help prevent crimes, misdemeanors and violations of Village ordinances and protect the health, safety, public peace and order of the Village and its inhabitants.

C. 
Report all street and sidewalk obstructions, unlighted street lamps, unlawful street signs or signals and defective or dangerous sidewalks or streets to the appropriate person or organization responsible for the repair or service.
D. 
Assist the Fire Department in maintaining order at the scene of a fire or any other fire response within the Village.
E. 
See that necessary permits and licenses issued by the Village are in possession of or properly displayed by any person engaged in an activity or business within the Village for which such permit or license is required and that the terms of the permits or licenses are complied with.
F. 
Perform such other lawful duties as ordered by the Chief of Police or the authorized representative.
A. 
Duties. The Chief of Police shall:
(1) 
Cause to be maintained an accurate record of complaints, crimes, traffic accidents, ordinance violations, arrests, summons, incidents, and calls for police service and shall provide a system of periodic summary and analysis to ensure the most efficient and effective deployment and use of the Department's resources. He shall submit or cause to be submitted to the various agencies such reports and summaries as are required by state statutes or ordinances and shall participate in voluntary programs designed to improve law enforcement and public safety.
(2) 
Submit such reports and comply with such procedures as may be prescribed by the Village President relative to fiscal and administrative matters.
(3) 
Have exclusive control over the assignment, hours of duty and transfer of all members of the Department.
(4) 
Plan, organize, staff, direct and control all human and material resources of the Department for the most effective and efficient discharge of duty to protect persons and property, preserve the peace, protect the rights of citizens and enforce the Wisconsin Statutes and ordinances of the Village as are within its jurisdiction. He shall supervise the preparation and presentation of annual reports and budgets for the Police Department. He shall be required to certify to the correctness of all bills incurred by the Department.
(5) 
Strive to maintain suitable relationships with other Village departments and with other governmental agencies and private organizations concerned with law enforcement, crime prevention, and administration of justice and public safety. He shall cooperate and exchange information with other Village departments in matters relating to their various functions.
(6) 
Plan and execute programs designed to prevent and repress crime, apprehend and prosecute offenders, recover property, and regulate noncriminal conduct, giving highest priority in the allocation of resources to crime and other offenses most hazardous to life and property.

B. 
Custody of Department equipment. The Chief of Police shall be the custodian of all Village property, equipment and supplies under the control of, or used by, the Police Department and shall be responsible for the care, maintenance, and safeguarding and accurate records of such property, equipment and supplies.
A. 
General. All Village of Mishicot Police Department records for which a specific retention period is not established in state statutes, federal law or regulation shall be retained by the Village of Mishicot Police Department for a period of not less than seven years, unless another retention period is designated in this section.
B. 
Purpose. The purpose of this section is to establish a Police Department records retention schedule and authorize destruction of Police Department records pursuant to that schedule on an annual basis. Record custodians do not have authority to destroy records prior to the established retention period unless such records have been photographically reproduced or transferred to optical disk format as original records pursuant to §§ 16.61(7) and 16.612, Wis. Stats., respectively.
C. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
LEGAL CUSTODIAN
The individual responsible for maintaining records pursuant to § 19.33, Wis. Stats.
MICROFILM REPRODUCTION
Any manner by which an image is reduced in size and reproduced on fine-grain, high-resolution film.
OPTICAL DISK and OPTICAL IMAGING
As defined in § 990.01(25g) and (25r), Wis. Stats., respectively.
RECORD
As defined in § 19.32(2), Wis. Stats.
RETENTION
The length of time in which records series are to be kept by the Village Police Department.

E. 
Historical Society notification. The State Historical Society of Wisconsin (SHSW) has waived the required statutory 60 days' notice under § 19.21(5)(d), Wis. Stats., for the records marked "W" which designates waived notice. The State Historical Society of Wisconsin must be notified prior to destruction of records marked "N" designating non-waiver. Notice is also required for records not listed in this section. "N/A" indicates not applicable and applies to all Village records designated for permanent retention.
F. 
Destruction after request for inspection. No requested record may be destroyed until after the request is granted or 60 days after the request is denied. If action is commenced under § 19.37, Wis. Stats., the requested record may not be destroyed until a court order is issued and all appeals have been completed. See § 19.35(5), Wis. Stats.
G. 
Destruction pending litigation. No record subject to pending litigation shall be destroyed until the litigation has been resolved.
H. 
Microfilming or optical disk storage of department records. Departments may keep and preserve public records through the use of microfilm or optical disk storage provided that the applicable standards established under §§ 16.61(7) and 16.612, Wis. Stats., respectively are met. Departments should consider factors such as retention periods and estimated costs and benefits of converting records between different media in deciding which records to microfilm or store on optical disk. After verification, paper records converted to either microfilm or optical disk storage should be destroyed. The retention periods identified in this section apply to records in any media.
The Chief of Police shall establish and promulgate rules of conduct, directives and policies and procedures and prescribe such duties for individual members as he may deem necessary for the effective and efficient command and operation of the Department, provided that no such rules of conduct, directive, policy, procedure, duties or assignment shall be in conflict with the statutes or ordinances or with any rules approved by the Village Board.
The Chief of Police shall cause to be maintained adequate personnel records of employment, assignment, promotions, attendance, performance and training for all members of the Department. He shall also comply with all provisions of the Law Enforcement Standards Board in regard to background investigations. He shall keep himself adequately informed of the activities of the Department and be assured that the duties of his subordinates are properly discharged. He shall formulate procedures for recognizing outstanding performance by the Department members, for investigating complaints of misconduct by any Department member and for the taking of appropriate disciplinary action, subject to the provisions of the applicable statutes and rules of the Department.
A. 
There is hereby established a Police Committee which shall consist of three members of the Village Board, one of which members shall be the President of said Village Board. The President of the Village Board shall appoint the other two members, who shall serve for a term of one year, and the Village President shall be Chairperson of said Committee and he shall issue all orders of the Police Committee to the police officers and shall likewise issue such other orders as in his discretion he deems necessary. The Police Committee shall meet three times per year set by the Department and Committee.
B. 
Powers. The Police Chief shall have complete and absolute control of all police matters with the exception of the following:
(1) 
Hiring and firing of police officers.
(2) 
Signing of contracts with officers.
(3) 
The expenditure of sums in excess of $250 for any one item.
All persons in the Village, when called upon by any police officer or peace officer, shall promptly aid and assist him in the execution of his duties, and whoever shall neglect or refuse to give such aid or assistance shall be subject to penalties in Wisconsin Statutes or Village ordinances. No person shall resist or in any way interfere with the police officer or peace officer in the discharge of his duty or shall hinder or prevent him or anyone from discharging his duty as such officer.
